BOARD PROCEDURE CONCERNING TESTIMONY FROM MEMBERS OF THE PUBLIC
AND CLOSING COMMENTS

After the close of testimony offered on behalf of the Applicant, members of the public will have the opportunity to present direct testimony concerning the application, followed by testimony by the Board’s consultants.

Public participation and Board deliberations will proceed generally along the following lines:

  • Any persons desiring to offer direct testimony and/or introduce documents into evidence prepared by them, shall come to the podium and identify themselves. These persons will then be sworn and can proceed to give testimony under oath concerning factual evidence which they wish to introduce for the Board’s consideration of the application. These persons will be subject to questioning by the Applicant’s Attorney, the Board’s professionals, as well as Members of the Planning Board. This portion of the proceedings is not to be confused with the opportunity for persons to come forward at the conclusion of the case in order to offer public comment concerning the application, which is not under oath and is not subject to their being questioned.
  • After all testimony has been received on behalf of all parties the case will be closed and no further evidence will be received in connection with the application. At this point, interested parties may come forward to the podium, identify themselves and offer such comments as they may wish to provide with respect to the application. In anticipation of the fact that it is likely that many people will want to be heard, each person offering closing comments will be limited to a four-minute time period, so that others waiting behind him or her can advance to make a presentation. If it should occur that a person is unable to finish comments which they had been prepared to deliver during a first opportunity to speak, then when all have had an opportunity to make closing comments that person will be able to return to the podium to complete his or her concluding remarks during an additional four-minute period.
  • After the public comment and closing remarks on behalf of the Applicant, the Board will proceed to discuss the application, in order to be in a position to adopt a motion authorizing the Board Attorney to prepare a resolution of approval or denial for action by the Board at an ensuing public meeting.
