Minutes of the Conference Meeting of the Borough Council held March 4, 2010, at 7:33 p.m. in the Council Chambers, Borough Hall, 531 Speedwell Avenue, Morris Plains, New Jersey.

Mayor Druetzler called the meeting to order and read the following notice:

ITEMS FOR DISCUSSION

 

Mayor Druetzler advised that Alana Garvaglia, a student at St. Elizabeth’s, was in attendance to gather information for a paper she is working on.

 

Councilmember McCluskey advised that Morris Plains once again ranked the number one municipality utilizing the Sheriff’s Labor Assistance Program. Over 150,711 man hours were spent working at the Recycling Center, landscaping the parks, and cleaning the center of town.

 

Mayor Druetzler provided information on items discussed at the Budget Meeting held on February 26th 2010, which included use of the siren by the Fire Department during funerals and the three-year Motorola contract. Councilmember Coogan added that the telephone maintenance contract with Quality Communications has expired. Much of the equipment at the Road Department was upgraded last month, resulting in less equipment. Councilmember Coogan recommended requesting a new quote based on these recent upgrades to obtain a better price.

 

Councilmember Karr asked if the County’s grant for pagers could apply to our Fire Department; Mayor Druetzler advised that we were one of the first ones to receive the updated pagers.

 

Relative to the budget, Mayor Druetzler also advised that one of the items to be discussed at the next meeting will be income, which is down. What was reviewed at the last meeting did not include the appropriation for reserve for uncollected taxes, which is a combination of municipal, county and school budgets; this should show an increase.

 

EXECUTIVE SESSION

RECOGNITION

 

Mayor Druetzler recognized two new police officers, Daniel Gallagher and Peter Rolph, who just graduated from the Police Academy.

 

Mayor Druetzler also recognized Alana Garvaglia, a senior at St. Elizabeth’s. Alana is taking a course in government and is in attendance to gather information on a paper she is writing.

 

Patrolman Gallagher and Patrolman Rolph spoke about their experiences at the Police Academy and shared some of their best and worst day stories.

 

Mayor and Council congratulated the two new officers and took a brief break to celebrate their graduation.

 

Mayor and Council opened the meeting at 9:00 p .m.

BE IT FURTHER RESOLVED

THAT Resolution No. 2010-43 entitled, "TRANSFER OF FUNDS," be adopted as attached.

 

THAT Resolution No. 2010-44 entitled, "A RESOLUTION REQUESTING THAT THE COUNTY OF MORRIS CONSIDER THE PROVISION OF LOCAL PUBLIC HEALTH SERVICES TO MUNICIPALITIES," be adopted as attached.

 

THAT Lisa Cortese, 16 Court Road, be appointed a member of the Beautification Committee which term expires December 31, 2010.

 

THAT Katherine Bezold, 44 Franklin Place, be hired as part-time Summer Camp Director for the 2010 Summer Recreation Program, at an annual salary of $5,000.00, effective March 5th 2010.

 

THAT having received quotes for the 2010 water treatment to Community Park Pond and Watnong Pond from the following:

THAT the Borough Treasurer be authorized to advertise for the receipt of bids for the Teen Center Sewer Lateral project, with bids to be received on Tuesday, April 13th 2010, up to 11:00 A.M., in the Council Chambers.

 

THAT the Borough Treasurer be authorized to advertise for the receipt of bids for the sidewalk repair along Littleton Road (Route 202 northbound), Route 53 curb cuts, Cornine Way, Thompson Way, curbing along one side of Sunset Road and drainage at Community Park improvement project, with bids to be received on Tuesday, April 13th 2010, up to 10:30 A.M., in the Council Chambers.

 

THAT the Borough Council grant permission to the Warner-Lambert/Pfizer Retirees Travel Club to park at the Simons Park Parking Lot from April 20th through April 30th 2010.

 

THAT the Borough Council approve the membership application of Joseph A. Barlotta, IV, 35 Sun Valley Way, Morris Plains, NJ, as a member of the Morris Plains Fire Department.

GREETINGS OF PUBLIC AND INVITATION FOR DISCUSSION

 

Mayor Druetzler opened the meeting to the public.

 

Ed Fletcher, Dogwood Road resident, commented on the 2010 budget. Mr. Fletcher referenced a recent snow storm and commended the Department of Public Works for doing a great job in keeping the roads open. Mr. Fletcher discussed a recent conversation with a county dispatcher regarding electrical outages.

 

Hearing no one else, Mayor Druetzler closed the public portion of the meeting.

REPORTS OF COMMITTEES AND/OR DEPARTMENT HEADS

 

Finance

Councilmember Karr reported that the first budget meeting was held on February 26th 2010, the next will be held on March 26th 2010. Councilmember Karr added that the first meeting went well.

Public Safety

 

Councilmember Cecala acknowledged Joseph Barlotta’s full membership on the Morris Plains Fire Department, as referenced on the Consent Calendar. Mr. Barlotta served many years as a junior member.

 

Councilmember Cecala reported on the 2009/2010 deer cull, advising that a total of 41 deer have been culled, 30 does and 11 bucks. He thanked all of the cullers for doing a good job. He extended gratitude to the Police Department, in particular, Detective Dobbins, for his help spearheading this project. Councilmember Cecala added that anyone desiring to participate could have their name added to the waiting list. Councilmember Cecala discussed deer culling programs in neighboring towns, as well as at the County level.

Public Works

Councilmember Coogan referenced the work duty list he and Councilmember McCluskey created at the beginning of the year. He stated that all of the inside work jobs have been completed by the Department of Public Works. Thermostats have also been replaced in all three of the Public Works’ Buildings in an effort to reduce bills.

 

Councilmember Coogan advised that the Department of Public Works received 300 tons of salt at the beginning of the season. The last snow storm depleted the supply. An additional 200 tons of salt was recently delivered. Diesel fuel also ran in short supply, however, the Finance Office arranged for key cards to the county supply. Normal deliveries from Finch Fuel have resumed.

 

Councilmember Coogan advised that July 23rd is the deadline for open space applications.

Public Buildings & Grounds

 

Councilmember McCluskey stated that a new Summer Recreation Director has been hired, as outlined on the Consent Calendar. The first meeting is this evening to work on the programs they will offer.

 

Councilmember McCluskey passed out the final Easter Bunny Breakfast signup sheets. The Recreation Commission has decided to go with a caterer and the Commission is looking for volunteers to help in the morning.

 

Councilmember McCluskey stated that the Parade Committee is meeting on Monday, March 8th 2010.

Public Welfare, Sanitation & Sewers

 

Councilmember Fu stated that the Board of Health and Municipal Alliance will be meeting next week, and she will have a report for the next meeting.

 

Councilmember Fu advised that the Teen Center bowling event was rescheduled for last Friday, February 26th, but had to be rescheduled once again due to inclement weather.

 

Councilwoman Fu reminded that the Municipal Alliance is working on two new programs, Robotics and Ceramics Classes, to be held after school at Borough School for third through eighth graders. The Ceramics Class is almost full and the Robotics Class filled up the first two days.

 

 

Ordinance & Public Utilities

 

Councilmember Zabihach advised that John Boudreau, Fire Prevention Official, has requested that an amendment be prepared on building address numbers.

 

Councilmember Zabihach advised that the Planning Board will meet on Monday, March 15th 2010 and the Board of Adjustment will meet on Monday, March 22nd 2010.

Chief Scott Thompson stated that the new graduation date for Daniel Gallagher and Peter Rolph is taking place tomorrow, March 5th 2010 at the Essex County Fire and Police Academy. The first graduation ceremony had to be rescheduled due to inclement weather.

 

Chief Scott Thompson provided a report on police department activities.

PRESENTATION OF COMMUNICATION, PETITIONS, ETC.

 

Mayor Druetzler opened the meeting to the public. Hearing no one, Mayor Druetzler closed the public portion.

INTRODUCTION OF ORDINANCES

 

Councilmember Zabihach introduced the following ordinance and read the same by title and moved that it be passed on first reading.

 

ORDINANCE NO. 3-2010

AN ORDINANCE PROVIDING FOR THE AMENDMENT OF CHAPTER 18, "POLICE DEPARTMENT," OF THE "REVISED ORDINANCES OF THE BOROUGH OF MORRIS PLAINS, NEW JERSEY, 1972" WITH THE PARTIAL AMENDMENT, SUPPLEMENTATION AND REVISION OF PARAGRAPH (C) IN SECTION 18-7 "QUALIFICATIONS."

 

Councilmember Cecala seconded the motion.

 

Mayor Druetzler stated that this ordinance represents a change in a date. In the near future we will be testing for Lieutenant and Sergeant positions.

Thereupon, Councilmember Zabihach offered the following resolution:

 

WHEREAS, the above ordinance was introduced and read by title at this meeting on March 4th 2010 and passed on first reading.

 

NOW, THEREFORE, BE IT RESOLVED at a meeting to be held on March 18th 2010 at 8:30 P.M. prevailing time in the Municipal Building in the said Borough, this Council will further consider for second reading and final passage of said ordinance.

 

AND BE IT FURTHER RESOLVED that the Clerk of this Borough be and she is hereby directed to publish the proper notice therefore, including the ordinance, post the ordinance on the Bulletin Board in the Municipal Building and make copies available to members of the general public.

 

Councilmember Karr seconded the resolution. All in favor.

Councilmember Zabihach read by title the ordinance entitled:

LIMITS AND TO ESTABLISH A CAP BANK (N.J.S.A. 40A:4-45.14)

 

which ordinance was introduced and passed on first reading at a meeting held on February 18th 2010.

 

The Clerk read the following notice:?

 

Notice is hereby given that the following ordinance was submitted in writing at a meeting of the Mayor and Borough Council of the Borough of Morris Plains, in the County of Morris and State of New Jersey held on February 18th 2010, introduced and read by title and passed on first reading, and that the said Governing Body will further consider the same for second reading and final passage thereof at a regular meeting beginning at 8:30 P.M., on March 4th 2010 at the Borough Hall, 531 Speedwell Avenue, Morris Plains, New Jersey, in said Borough at which time and place a public hearing will be held thereon by the Governing Body and all parties in interest and citizens and all persons shall have an opportunity to be heard concerning said ordinance.

 

Councilmember Zabihach read the following notice and ordinance by title and stated that the Notice and Ordinance had been published as required by law that the ordinance had been posted on the bulletin board in the Municipal Building and that copies had been made available to members of the general public.

 

Mayor Druetzler announced that the meeting was open for a public hearing on the ordinance and stated that any taxpayer of the Borough of Morris Plains and all parties and persons in interest and citizens may be heard.?

Mayor Druetzler explained this Ordinance is prepared annually; it does not mean that we will exceed the CAP; it affords the Borough that flexibility.

Seeing no one, Mayor Druetzler closed the Public Hearing.

 

Thereupon Councilmember Zabihach offered the following Resolution and moved its adoption:

RESOLVED, That the above ordinance as read by title on Second Reading, at this meeting, be adopted and finally passed.

 

Councilmember McCluskey seconded the motion.

 

Mayor Druetzler ordered the Clerk to call the roll on the passage thereof and the vote was as follows:
