Minutes of the Conference Meeting of the Borough Council held October 7, 2010, at 7:34 p.m. in the Council Chambers, Borough Hall, 531 Speedwell Avenue, Morris Plains, New Jersey.

Mayor Druetzler called the meeting to order and read the following notice:

DISCUSSION ITEMS

 

Mayor Druetzler referenced some items on the Consent Calendar, including Clorinda Landi’s membership on the Beautification Committee, applying for various grants including the Police Department Accreditation, approving water service outside the district, adopting a policy on absence from meetings, and purchasing a police vehicle.

 

Councilmember Karr stated another meeting was held after the last council meeting to address the Governing Body’s comments and concerns relative to the Personnel Policies and Procedures Manual. Afterward Attorney Fraser reviewed the changes and e-mailed the revisions to the Governing Body. The next step will include comments from department heads.

 

EXECUTIVE SESSION

BE IT RESOLVED THAT Resolution No. 2010-109 entitled, "Executive Session" be adopted.

THAT John Scagnelli be granted permission to serve alcoholic beverages at a Family Picnic to be held Tuesday, October 12th 2010, with a raindate of Wednesday, October 13th 2010, from 11:00 A.M. to 5:00 P.M., at Community Park.

THAT the Borough Treasurer be authorized to advertise for the receipt of a two (2) year bid for Shade Tree Work for the years 2011/2012, with bids to be received on Wednesday, November 17th 2010, up to 10:00 A.M., in the Council Chambers.

THAT the Borough Council authorize the purchase of one (1) 2011 Ford Crown Victoria Pursuit Vehicle, from Warnock Fleet & Leasing, East Hanover, New Jersey, under the Morris County Co-Operative Purchasing Contract, in the amount of $23,923.20, which contract was awarded through a fair and open process pursuant to N.J.S.A. 19:44A-20.4 et seq.

THAT Morris United Soccer Club be granted permission to install temporary lighting at Memorial Field for the fall soccer season, September 7th 2010 to November 26th 2010.

THAT the residents of Hawthorne Avenue, Homer Avenue, Carlyle Avenue and Sunset Road be granted permission to hold its annual Block Party on Saturday, October 9th 2010, with a raindate of Sunday, October 10th 2010, from 4:00 P.M. to Midnight and that permission to serve alcoholic beverages be granted; and that the Road Department provide the necessary barricades.

THAT the Susan G. Komen for the Cure North Jersey Affiliate be granted permission to tie pink ribbons on the trees along Speedwell Avenue in recognition of National Breast Cancer Awareness Month, October 2010.

GREETINGS OF PUBLIC AND INVITATION FOR DISCUSSION

 

Mayor Druetzler opened the meeting to the public.

 

Troy Robbinson, freelance writer on Patch.com, introduced himself.

 

Hearing no one else, Mayor Druetzler closed the public portion of the meeting.

 

REPORTS OF COMMITTEES AND/OR DEPARTMENT HEADS

 

Finance

Councilmember Karr referred to the grant monies received for Speed Crackdown, Buckle Up, and Clean Communities Program.

 

Councilmember Karr advised that the 2011 budgets will be given to department heads next week.

 

Councilmember Karr stated that changes in personnel in the Tax Office started this past week, and they are working well together.

 

Public Safety

 

Councilmember Cecala stated that 13 deer have been culled to date.

 

Councilmember Cecala advised that the 9-11 Commission members met at the corner of Routes 53 and 202 to review the area for the Memorial. Another meeting is scheduled for next Wednesday, October 13, 2010 with the architect. The site has been marked with a yellow circle.

Chief Scott Thompson reported on police department activities.

 

Public Works

Councilmember Coogan stated that the DPW report was distributed. Two key items are the new roof on the Teen Center and the preliminary work at Morris Plains Farms a/k/a Community Garden. DPW delivered three truck loads of compost. George Ross of the Beautification Committee has prepared plans for the layout of the garden. It is hopeful the garden will be ready by next spring.

 

 

Public Buildings & Grounds

 

Councilmember McCluskey stated that approximately 75 households participated in the Town Wide Garage Sale on October 4 and 5, 2010. There were many visitors in town who took advantage of the local merchant coupons that were included in the Recreation handout that listed the locations of the yard sales.

 

Councilmember McCluskey advised that the Bon Fire on October 23, 2010 at the Community Center will be more exciting this year. There will be a family scavenger hunt, hayrides, games, and a magic show. Boy Scouts will be preparing the food.

 

Councilmember McCluskey stated that there are two more weekends for the Farmers Market. The Teen Center will have a fundraiser this week selling bulb kits and candy apples.

 

 

Public Welfare, Sanitation & Sewers

 

Councilmember Fu stated that the Recycling Committee’s fall meeting will be held on Monday, October 25, 2010. The Morris County Recycling Awards Dinner is on November 5, 2010.

 

Councilmember Fu reported that the Board of Health’s Wellness Day will be held on Saturday, October 16, 2010 from 8:00 a.m. to 12:00 noon at the Community Center. Flu Clinics will be on October 16th from 10:00 to 11:00 a.m. and October 23, 2010 from 10:30 a.m. to 12:00 noon at the Community Center. A Flu Clinic will be held for Borough employees on Wednesday, October 27, 2010 from 12:30 to 1:30 in Council Chambers.

 

Councilmember Fu advised that the Teen Center’s first event was a carnival that took place last Friday night at the Community Center. It was attended by 120 students. They will hold their next event for the 8th graders on October 15th at the Teen Center house. As Councilwoman McCluskey mentioned, the Teen Center will be holding a fundraiser at the Farmers Market this Saturday, October 9, 2010.

 

Councilmember Fu reported the Municipal Alliance is now on Facebook.com. Drug Free Schools Week is coming up October 24 – 30, 2010. There will be an assembly entitled "Overcoming Personal Obstacles," featuring two speakers. They will be holding a Parent Lunch and Learn on Wednesday, October 27, 2010. Borough School Student Council will be attending the next council meeting to discuss Red Ribbon Week.

 

Ordinance & Public Utilities

 

Councilmember Zabihach discussed the energy audit, which included an inspection of the municipal buildings to determine needs. The energy audit was done in order to determine our eligibility to receive grant money that is available to upgrade municipal facilities to help improve energy efficiency.? We could possibly receive up to $50,000 in funding to make improvements?at Town Hall as well as at the DPW buildings.
There is a $50,000 limit. We will receive a report in two to three weeks outlining their recommendations.

 

Councilmember Zabihach advised that a meeting was held this past August with Mayors from other towns and representatives of utilities to discuss upgrades to the power grid and power lines that were recommended by the National Park Service. A follow-up meeting will be held on Thursday, October 21, 2010 to discuss the status of the public hearings.

ORDINANCES OF FIRST READING

Councilmember Zabihach read by title the ordinance entitled:

 

ORDINANCE NO. 12-2010

 

AN ORDINANCE TO PROVIDE FOR THE PARTIAL AMENDMENT, SUPPLEMENTATION AND REPEAL OF "CHAPTER 13, 2000 BOROUGH OF MORRIS PLAINS LAND DEVELOPMENT ORDINANCE" WITH THE RECLASSIFICATION OF THE EXISTING R-6 RESIDENCE ZONE FROM AGE-RESTRICTED CONDOMINIUM/TOWNHOUSE DWELLING UNITS TO A NEW R-6 RESIDENCE ZONE PERMITTING MULTI-FAMILY RESIDENTIAL DWELLING UNITS

 

which ordinance was introduced and passed on first reading at a meeting held on September 2, 2010.

The Clerk read the following notice:?

Notice is hereby given that the following ordinance was submitted in writing at a regular meeting of the Mayor and Borough Council of the Borough of Morris Plains, in the County of Morris and State of New Jersey held on September 2, 2010, introduced and read by title and passed on first reading, and that the said Governing Body will further consider the same for second reading and final passage thereof at a regular meeting beginning at 8:30 P.M., on October 7, 2010 at the Borough Hall, 531 Speedwell Avenue, Morris Plains, New Jersey, in said Borough at which time and place a public hearing will be held thereon by the Governing Body and all parties in interest and citizens and all persons shall have an opportunity to be heard concerning said ordinance.

 

Councilmember Zabihach read the following notice and ordinance by title and stated that the Notice and Ordinance had been published as required by law, that the ordinance had been posted on the bulletin board in the Municipal Building and that copies had been made available to members of the general public.

 

Mayor Druetzler announced that the meeting was open for a public hearing on the ordinance and stated that any taxpayer of the Borough of Morris Plains and all parties and persons in interest and citizens may be heard.? Mayor Druetzler advised that this ordinance changes the zone from age restricted condominiums to multi family units. The age restricted originally had proposed 86 units; the multi-family has 70 units proposed. Hearing no one, Mayor Druetzler closed the public hearing.

 

Councilmember Coogan moved to table adoption of the ordinance to the next meeting of October 21, 2010 in order to provide definitions to some of the terms. Councilmember Karr seconded the motion.
