Minutes of the Conference Meeting of the Borough Council held December 16, 2010, at 7:30 p.m. in the Council Chambers, Borough Hall, 531 Speedwell Avenue, Morris Plains, New Jersey.

Mayor Druetzler called the meeting to order and read the following notice:

DISCUSSION ITEMS

 

Mayor Druetzler and Councilmembers discussed liaison, board, and committee appointments for 2011. Councilmember Fu stated that there are two people who would like to join Municipal Alliance, Natalie Cahill and Carolina Garavaglia.

 

Councilmember Karr advised that the Morris Minute Men reviewed a draft resolution to oppose the State’s recommendation to revise the requirements for medical service delivery. Their comments were not available this evening and will be addressed at the next meeting on December 30th 2010.

 

Mayor Druetzler that contracts for the Borough Attorney and Borough Engineer will be reviewed.

 

Councilmember Zabihach advised that he and the Mayor missed the December 2nd 2010 meeting and he understood that members of the public attended the meeting to discuss concerns relative to property management. Councilmember Zabihach met with the Zoning Officer to review his documentation, including summonses that have been issued. Councilmember Zabihach read a letter received from a property owner requesting more specific information on an ordinance. Councilmember Zabihach said he and the Ordinance Committee will need to address language in the ordinances in 2011, specifically when discussing trailers and trucks.

 

Councilmember Fu advised that the New Jersey Theatre Alliance made a presentation to the Municipal Alliance at their meeting on Monday night. They offer several theatre troops who go to various locations and put on shows free of charge. The Municipal Alliance can charge for their performance as a fundraiser. The Municipal Alliance believes this fits in with their programs, supports their Stage Fund and Summer Theatre Program, and fits in line with events for our youth. The Community Center has been reserved; however, the school may be a viable option as well.

BE IT FURTHER RESOLVED

 

THAT Resolution No. 2010-140 entitled, "REFUND OF OVERPAYMENT," be adopted as attached.

THAT Resolution No. 2010-141 entitled, "CANCEL UNEXPENDED AND DEDICATED BALANCES OF GENERAL CAPITAL APPROPRIATIONS," be adopted as attached.

THAT the Mayor be and he hereby is authorized to execute the New Jersey Clean Energy Direct Install Program Participation Agreement Scope of Work Attachment, and Direct Install Contract Agreement with Donnelly Energy Solutions, in the form approved by the Borough Attorney, which contract is entered into with a Participating Contractor approved by the State of New Jersey Department of Community Affairs as to the bid and contractor selection process under the New Jersey Office of Clean Energy Direct Install Program.

THAT the attached be hired for the 2010 Winter Recreation Programs at the date and salary stated.

THAT the Borough Council authorize the release and return of the one year maintenance, Maintenance Bond No. 019029286M, Speedwell Avenue and Speedwell Avenue Extension Improvements, to Zuccaro & Sons, Inc., in the amount of $15,256.16, per the Borough Engineer’s correspondence dated December 14th 2010.

THAT the resignation of Mark Belles, Recycling Co-Cordinator, be accepted effective December 31st 2010.

GREETING OF PUBLIC AND INVITATION FOR DISCUSSION

Lads from Ireland

Mayor Druetzler addressed Father Bill of Delbarton and guests, Conor Hughes and Eain Hurley from Ireland. Mayor, Council, Borough professionals, the Borough Clerk, and Chief of Police discussed how government works in Morris Plains and their roles and responsibilities. Conor and Eain spoke about their families, school, and their appreciation for this opportunity to come to Morris Plains. Father William also spoke and explained the student exchange program.

Mayor Druetzler offered the boys sweatshirts and gift certificates to Friendlys.

REPORTS OF COMMITTEES AND/OR DEPARTMENT HEADS

 

Finance

Councilmember Karr stated that beginning January 1st 2011 the Tax Office will be open Monday through Thursday, 9:00 a.m. to 1:00 p.m. When the Tax Office is closed, tax payments will be received through the Finance Office. The Tax Assessor’s hours will be on the second and fourth Tuesday of each month, 6:00 p.m. to 8:00 p.m.

Public Safety

 

Councilmember Cecala advised that the Chief of Police sent out letters to Glenbrook Road residents informing them of the parking changes. There has been no feedback.

 

Councilmember Cecala reported that the deer cull numbers are the same as the last meeting due to Pennsylvania’s hunt, which included deer and bear.

 

Councilmember Cecala stated that he received a letter from Bob O’Brien announcing a Cornhole fundraiser on January 29, 2011 from noon until 5:00 p.m. at the Morristown Hyatt to raise money for a sick child. Donations and tricky tray baskets would be appreciated.

 

Chief Scott Thompson reported on police department activities.

Public Works

Councilmember Coogan stated that the Department of Public Works report was distributed and added leaf collection is ongoing and salt spreaders are getting ready for the winter season.

 

Councilmember Coogan reported that he attended the last Open Space Committee meeting for the year. A County Appraiser will oversee some of the appraisals submitted for approval; this may accelerate the application process.

 

Engineer Hall provided a report on the Speedwell Avenue project and the 2011 Capital Improvements to various roads. We are still waiting to hear from the State regarding the municipal aid grant.

Public Buildings & Grounds

 

Councilmember McCluskey advised that the Recreation Commission has set the dates for the 2011 events. They have also selected their winter classes, which include a personal safety seminar and a weight loss program.

 

Councilmember McCluskey stated that the Holiday Decorating Contest continues through December 19, 2010.

Public Welfare, Sanitation & Sewers

 

Councilmember Fu advised that the Teen Center went to Mennen Arena for an ice skating event last Friday. The next event, a video dance party, will be on January 7, 2011. Penny Manser has been utilizing the student representatives, who have been attending meetings and providing feedback.

 

Councilmember Fu advised that there will be a Rabies Clinic sponsored by the Board of Health on Saturday, January 15, 2011 from 1:00 to 3:00 p.m. at the Borough Garage. Bob Heiser’s last meeting was celebrated for 33 years of service.

 

Councilmember Fu reported that the Municipal Alliance will include the New Jersey Theatre Alliance, a program designed to offer families the thrill of professional theater, at affordable or free presentations. The Senior Lunch and Learn was held today and 65 people attended. Kids Helping Kids had a parent program last week and was attended by 27 people, which is a pre-cursor to the Magic of Reading Program coming up. Stage Fund has been held for grades 3 to 5 at Borough School and there were 25 participants. They will be performing tomorrow at 4:30 p.m.

 

Councilmember Fu reported on the Recycling Committee and added that Mark Belles’ resignation was on the consent calendar this evening. He will still be on the committee.

 

Councilmember Fu stated that we approved our agreement with Denville to handle our animal control for the next two years. The agreement is expected to be approved by Denville at their meeting next Tuesday. Calls will go through the Denville Police Department. Once the agreements have been signed, St. Hubert’s will be notified.

Ordinance & Public Utilities

 

Councilmember Zabihach reported that the Planning Board met on Monday and the agenda included consideration of Ordinance 13-2010, amending the sign ordinance, and the ACP application.

 

Councilmember Zabihach advised that the public commentary at the last meeting relative to property management has been addressed by the zoning officer. Letters have been sent out to property owners and two summonses have been issued.

Council-member Zabihach introduced the following ordinance and read the same by title and moved that it be passed on first reading.

 

ORDINANCE NO. 18-2010

AN ORDINANCE PROVIDING FOR THE PARTIAL AMENDMENT AND SUPPLEMENTATION OF SECTION 22-11, "PARKING PROHIBITED AT CERTAIN TIMES," IN CHAPTER 22, "TRAFFIC AND PARKING," OF THE "REVISED ORDINANCES OF THE BOROUGH OF MORRIS PLAINS, NEW JERSEY, 1972" TO ESTABLISH A NEW PARKING RESTRICTION ON A PORTION OF GLENBROOK ROAD.

 

Councilmember Cecala seconded the motion.

Mayor Druetzler announced that the meeting was open for a public hearing on the ordinance and stated that any taxpayer of the Borough of Morris Plains and all parties and persons in interest and citizens may be heard.? Seeing no one, Mayor Druetzler closed the Public Hearing.

Thereupon Councilmember Zabihach offered the following Resolution and moved its adoption:

RESOLVED, That the above ordinance as read by title on Second Reading, at this meeting, be adopted and finally passed.

 

Councilmember Cecala seconded the motion.

 

Mayor Druetzler ordered the Clerk to call the roll on the passage thereof and the vote was as follows:

 

Yeas: Councilmembers Karr, Cecala, Coogan, Fu, McCluskey & Zabihach

Nays: None

Absent: None

Abstain: None

Mayor Druetzler declared the ordinance adopted and finally passed, approved the same and ordered the Clerk to publish the proper notice thereof in the newspaper and to record the ordinance in the proper place.
