Minutes of the Conference Meeting of the Borough Council held December 30, 2010, at 7:35 p.m. in the Council Chambers, Borough Hall, 531 Speedwell Avenue, Morris Plains, New Jersey.

Mayor Druetzler called the meeting to order and read the following notice:

I HEREBY ANNOUNCE AND STATE THAT ADEQUATE NOTICE OF THIS MEETING WAS PROVIDED BY VIRTUE OF A RESOLUTION SCHEDULING THE TIME, DATE, AND PLACE OF MEETINGS OF THE BOROUGH COUNCIL OF THE BOROUGH OF MORRIS PLAINS FOR THE YEAR 2010; WHICH RESOLUTION WAS ADOPTED BY THE BOROUGH COUNCIL ON JANUARY 8TH 2010, AND WAS PUBLISHED IN THE MORRIS NEWSBEE AND IN THE DAILY RECORD AND BY THE FORWARDING OF SUCH RESOLUTION TO ALL PERSONS ON THE REQUEST LIST; BY THE POSTING OF SUCH RESOLUTION ON THE BULLETIN BOARD IN THE BOROUGH HALL; ALL OF THE ABOVE ACTIONS BEING IN ACCORDANCE WITH N.J.S.A. 10:4-6, ET SEQ.

DISCUSSION ITEMS

 

Mayor Druetzler advised that Councilmember Joseph Cecala, Jr. is out-of-state this evening.

 

Mayor Druetzler stated that appointments for 2011 will remain the same, Councilmember Suzanne B. McCluskey will be nominated for Council President, there are two new people on the Municipal Alliance, and Robert Heiser will be replaced on the Board of Health. Councilmember Karr advised that two additional people asked if they could be on the Recycling Committee, Tom Connolly and Paul Clolery.

 

Councilmember Fu advised that she spoke with the Denville Administrator regarding an amendment to the Animal Control Agreement.

 

Councilmember Karr provided an update on revisions to the Personnel Policies and Procedures Manual. Additional changes that were discussed include comp time, attendance at meetings and conferences, luncheons, hours of work, etc. It is the subcommittee’s hope that the revisions will be finalized by the end of January 2011.

EXECUTIVE SESSION

Moved by Councilmember Coogan:

 

BE IT RESOLVED THAT Resolution No. 2010-146 entitled, "Executive Session" be adopted.

 

Seconded by Councilmember Zabihach. So ordered.

 

Councilmember Karr moved to adjourn the meeting at 8:25 p.m.

APPROVAL OF CONSENT CALENDAR

 

Councilmember Karr moved:

 

BE IT RESOLVED by the Mayor and Council of the Borough of Morris Plains, that the attached reports be accepted and that said reports be kept on file in the Clerk’s Office:

 

REPORTS

BE IT FURTHER RESOLVED

 

THAT Resolution No. 2010-147 entitled, "TRANSFER OF FUNDS," be adopted as attached.

THAT Resolution No. 2010-148 entitled, "SALARIES FOR REGULAR FULL TIME AND PART TIME EMPLOYEES," be adopted as attached.

THAT Resolution No. 2010-149 entitled, "RESOLUTION OF THE BOROUGH COUNCIL OF THE BOROUGH OF MORRIS PLAINS OPPOSING ASSEMBLY BILL NO. A-2095 AND SENATE BILL NO. 2-818 WHICH REVISE REQUIREMENTS FOR MEDICAL SERVICE DELIVERY," be adopted as attached.

THAT the Mayor be and he hereby is authorized to execute the NJDOT Highway Occupancy Permit Application and NJDOT Maintenance Agreement for improvements to Speedwell Avenue northbound from Academy Road to Morris Plains Avenue and in front of the Morris Plains Train Station, Contract 2011.08, per the Borough Engineer’s correspondence of December 23rd 2010.

 

THAT the Interlocal Shared Services Contract with Denville Township for Animal Control Services be amended to provide an emergency call rate of $42.18 between the hours of 3:00 p.m. and 7:00 a.m.

 

Mayor Druetzler advised that he heard from Kevin Fletcher who advised that his father, Ed, had successful surgery.

Finance

Councilmember Karr did not have a report.

Public Safety

 

Chief Scott Thompson reported on police department activities.

Public Works

Councilmember Coogan stated that the Department of Public Works report was distributed and added leaf collection has been completed for the year. Assistance was given to Morris Township with their leaf collection and they assisted us with putting up snowflakes as part of a Shared Services Agreement. DPW switched the leaf boxes with the salt spreaders. Repairs are being made to some equipment damaged by the first snow storm of the season.

 

Councilmember Coogan reported paperwork he submitted on the Energy Grant was accepted and we will be receiving a $50,000 grant from the State to upgrade all of the lighting in the Municipal Building and add electronic controls to the boilers. The next step is to have a pre-engineering walk through and then the work can begin. The program has been extended and another $50,000 grant will be offered in 2011.

Public Buildings & Grounds

 

Councilmember McCluskey stated that the winner of the Holiday Decorating Contest was picked.

 

Councilmembers McCluskey and Coogan will conduct their annual tour of the buildings and grounds to make a list of items requiring repairs or upgrades.

Public Welfare, Sanitation & Sewers

 

Councilmember Fu advised that she has nothing new to report; however, reminded there will be a Rabies Clinic sponsored by the Board of Health on Saturday, January 15, 2011 from 1:00 to 3:00 p.m. at the Borough Garage.

Ordinance & Public Utilities

 

Councilmember Zabihach reported that property maintenance concerns expressed by residents at a previous meeting have been remediated by the Zoning Officer.

ORDINANCES OF FIRST READING

ORDINANCES ON SECOND READING

Councilmember Zabihach read by title the ordinance entitled:

 

ORDINANCE NO. 18-2010

AN ORDINANCE PROVIDING FOR THE PARTIAL AMENDMENT AND SUPPLEMENTATION OF SECTION 22-11, "PARKING PROHIBITED AT CERTAIN TIMES," IN CHAPTER 22, "TRAFFIC AND PARKING," OF THE "REVISED ORDINANCES OF THE BOROUGH OF MORRIS PLAINS, NEW JERSEY, 1972" TO ESTABLISH A NEW PARKING RESTRICTION ON A PORTION OF GLENBROOK ROAD.

 

The Clerk read the following notice:?

Notice is hereby given that the following ordinance was submitted in writing at a meeting of the Mayor and Borough Council of the Borough of Morris Plains on December 16, 2010, introduced and read by title and passed on first reading, and that the said Governing Body will further consider the same for second reading and final passage thereof at a regular meeting beginning at 8:30 P.M., on December 30, 2010 at the Borough Hall, 531 Speedwell Avenue, Morris Plains, New Jersey, in said Borough at which time and place a public hearing will be held thereon by the Governing Body and all parties in interest and citizens and all persons shall have an opportunity to be heard concerning said ordinance.

 

Councilmember Zabihach read the following notice and ordinance by title and stated that the Notice and Ordinance had been published as required by law that the ordinance had been posted on the bulletin board in the Municipal Building and that copies had been made available to members of the general public.

 

Mayor Druetzler announced that the meeting was open for a public hearing on the ordinance and stated that any taxpayer of the Borough of Morris Plains and all parties and persons in interest and citizens may be heard.? Mayor Druetzler explained that this ordinance was recommended by the Morris Plains Police Department and the Traffic Committee. Seeing no one, Mayor Druetzler closed the Public Hearing.

 

Thereupon Councilmember Zabihach offered the following Resolution and moved its adoption:

RESOLVED, That the above ordinance as read by title on Second Reading, at this meeting, be adopted and finally passed.

 

Councilmember McCluskey seconded the motion.

 

Mayor Druetzler ordered the Clerk to call the roll on the passage thereof and the vote was as follows:

Mayor Druetzler declared the ordinance adopted and finally passed, approved the same and ordered the Clerk to publish the proper notice thereof in the newspaper and to record the ordinance in the proper place.
