Board of Health Meeting Minutes 01/12/11

Minutes of the Reorganization Meeting of the Morris Plains Board of Health held January 12, 2011, at 7:31 P.M., in the Council Chambers, Borough Hall, 531 Speedwell Avenue, Morris Plains, New Jersey.

The following members were present:

Pledge of Allegiance

Call to Order

The meeting was called to order by Mrs. Dugan. Mrs. Dugan stated that adequate notice of this meeting has been published and posted in accordance with Chapter 231 of the Public Laws of 1975, "Open Public Meetings Act."

Nominations of Officers

Mrs. Dugan called for nominations to the office of President. Mrs. Marshall nominated Mrs. Dugan. Mr. Ripley seconded the motion. There were no further nominations.

Roll Call:

Yeas: Mrs. Marshall, Mrs. Nelson, Mr. Ripley, Dr. Fenimore

Nays: None

Absent: None

Abstain: Mrs. Dugan

Motion carried.

Mrs. Dugan called for nominations to the office of Vice President. Mrs. Dugan nominated Mrs. Marshall. Mr. Ripley seconded the motion. There were no further nominations.

Appointments

Mrs. Dugan then made the following Appointments to the Board:

Mrs. Carole Howell – Secretary

Mrs. June Uhrin – License Clerk

Dr. Kenneth Werner - Veterinarian

Mrs. Marshall moved to approve the appointments, seconded by Mrs. Nelson. All were in favor.

Motion carried.

Mrs. Dugan then made the following Liaison Appointments to the Board:

Mrs. Nelson – Municipal Alliance Council Liaison

Mrs. Marshall – Publicity

Mr. Ripley - Publicity

Mrs. Dugan – Emergency Management Council

Mrs. Marshall moved to approve the appointments, seconded by Mrs. Nelson. All were in favor.

Motion carried.

Resolutions:

Mrs. Dugan stated that the following Resolutions are to be adopted for the year 2011.

RESOLUTION 2011-01

WHEREAS: Section 14 of Chapter 231 of the Public Laws of 1975, "Open Public Meetings Act," provides that any person may request that a public body mail to him copies of any regular and conference meetings schedule or revision thereof described in Section 13 of that Act; and

WHEREAS, Section 14 of Chapter 231 of the Public Laws of 1975, "Open Public Meetings Act", provides that a public body may require prepayment by persons making such requests of a reasonable sum to cover the cost of providing such notice.

WHEREAS, Section 14 of Chapter 231 of the Public Laws of 1975, "Open Public Meeting Act" provides that any person may request that a public body mail to him copies of any advance written notice described in Section d(d) of that act: and

NOW, THEREFORE, IT IS HEREBY RESOLVED by the Board of Health of the Borough of Morris Plains that the following procedure be, and the same hereby is, adopted by the Board of Health of the Borough of Morris Plains to comply with the said Section 14 of Chapter 231 of the Public Laws of 1975, "Open Public Meetings Act."

  1. Any person requesting copies of the regular and conference meetings schedule of revision thereof provided in Section 13 of said Act and advanced written notice of the Board of Health of the Borough of Morris Plains.
  2. Accompanying such written application shall be cash, check or money order in
  3. the amount of Thirty ($30.00) dollars.

  4. The Secretary of the Board of Health shall maintain a record of account for each
  5. person making the written application provided for in Paragraph I hereof and shall

    turn the Thirty ($30.00) dollars over to the Treasurer of the Borough of

    Morris Plains for deposit.

  6. As each schedule, revised schedule, or advance written notice is mailed to the
  7. person requesting same, the sum of Ten ($10.00) dollars shall be deducted in the record of his account as maintained by the Secretary of the Board of Health.

  8. At the end of the year 2011, if any balance shall remain in the account of any
  9. person, pursuant to the terms of this procedure, then and in the event, the

    Secretary of the Board of Health shall so notify the Treasurer of the Borough of

    Morris Plains, who shall take the necessary steps to refund such balance.

  10. If at any time during the year 2011, the balance in the account of any person is
  11. reduced to "zero", then, and in that event, a further deposit of Thirty ($30.00) dollars shall be required prior to the mailing of any further schedules,

    revised schedules or notices.

  12. All requests for notices, made pursuant to the terms of this procedure, shall be
  13. subject to renewal upon a new request to the Secretary of the Board of Health.

  14. Nothing contained herein shall be construed to require the payment of any fees to the news media.

BE IT FURTHER RESOLVED, by the Board of Health of Morris Plains that thisResolution has been adopted in order to comply with Chapter 231 of the Public Laws of 1975, "Open Public Meetings Act."

RESOLUTION 2011-02

WHEREAS, Section 3(d) of Chapter 231 of the Public Laws of 1975, "Open Public Meetings Act", requires adequate notice; and

WHEREAS, The said Section 3(d) of that Act defines "adequate notice":

NOW, THEREFORE, IT IS HEREBY RESOLVED by the Board of Health of the Borough of Morris Plains that:

  1. The Secretary of the Board shall give written notice, at least 48 hours in advance, of any conference or special meeting of the Board of Health of the Borough of Morris Plains.
  2. Said notice shall specify the time, date and location and, to the extent known, the agenda of any conference or special meetings.
  3. As to any such meeting where formal action may be taken, the notice shall so specify.
  4. The said notice shall be (a) prominently posted on the bulletin board in the Municipal Building where notices of such kind are normally posted; (b) mailed, telephoned, faxed, or hand delivered to the Morris County Daily Record and the Morris News Bee: (c) filed with the Clerk of the Borough of Morris Plains; and (d) mailed to those persons on the request list.

BE IT FURTHER RESOLVED, by the Board of Health of the Borough of Morris Plains, that this resolution is being adopted in order to comply with Chapter 231 of the Public Laws of 1975, "Open Public Meetings Act."

RESOLUTION 2011-03

BE IT RESOLVED by the Board of Health of the Borough of Morris Plains, County of Morris, State of New Jersey, as follows:

  1. The Secretary of the Board of Health of the Borough of Morris Plains is hereby directed to make available to the general public the Minutes of the regular and conference meetings of the Board of Health of the Borough of Morris Plains as soon as practicable after the conclusion of the said meetings.
  2. The Minutes of the regular and conference meetings of the Board of Health of the Borough of Morris Plains shall be reasonable, comprehensive and shall show, as minimum, the following:
  1.  
    1. the time, date and place of meeting
    2. the members present
    3. the subjects considered
    4. the actions taken
    5. the vote of each member
    6. any other information required to be shown by Law.
  1. The Secretary of the Board of Health shall charge for the said Minutes the fee regularly charged by the Borough of Morris Plains, that is one ($1.00) dollar per sheet.
  2. This resolution is being adopted in order to comply with Chapter 231 of the Public Laws of 1975, "Open Public Meetings Act."

RESOLUTION 2011-04

BE IT RESOLVED, by the Board of Health of the Borough of Morris Plains in the County of Morris in the State of New Jersey as follows:

1. During the year 2011 the regular meetings of the Board of Health of this Borough shall be held at 7:30 PM on the second Wednesday of each month.

2. All said regular meetings in which formal action may be taken will take place in the Council Chambers.

3. Exact dates of aforesaid regular meetings in the year 2011 are:

January 12th, February 9th, March 9th, April 13th,

May 11th , June 8th, July 13th, August 10th, September 14th,

October 12th, November 9th, December 14th and January 12th 2012.

4. At any meeting where an agenda is to be used, said agenda shall be furnished to all persons in attendance at the meeting.

5. All persons are invited to all of the meetings hereinbefore set forth.

6. The Secretary of the Board of Health is directed to prominently display, post and maintain posted throughout the year upon the bulletin board in the Borough Hall a certified copy of this resolution. In addition, the Secretary of the Board of Health is directed to mail forth with a certified copy of this resolution, for publication to the following:

Morris News Bee

Also, the Secretary of the Board of Health shall maintain in her file a certified copy of this resolution.

7. This resolution is being adopted in order to comply with P.D. 1975, Chapter 231, "Open Public Meetings Act."

8. This resolution shall take effect immediately.

There being no further business , Mrs. Nelson moved to adjourn the meeting , seconded by Mr. Ripley. Voice vote. All in favor. Motion carried. The meeting adjourned at 7:44 PM.

Call to Order

The meeting was called to order by Mrs. Dugan. Mrs. Dugan stated that adequate notice of this meeting has been published and posted in accordance with Chapter 231 of the Public Laws of 1975, "Open Public Meetings Act."

Board Member

Mrs. Dugan introduced Dr. Fenimore to the Board. Dr. Fenimore was welcomed by members.

Approval of Minutes

Laurie Fu made the following change to the Council News section of the Minutes of the December 8th 2010. The second sentence should be amended to read: " Laurie has talked to Steve Welsh and was assured that he is willing to work with Madison to create a link for Morris Plains on the website."

Mr. Ripley moved that the minutes of the December 8th 2010 Regular Meeting be approve as amended, seconded by Mrs. Marshall. All in favor.

COMMENTS FROM THE PUBLIC

None

Reports

Mr. Samara reported on food establishment and municipal parking lot inspections made during December.

Mr. Samara reported that he met with food store managers regarding the nationwide terrorism food alert.

Mr. Heiser stated that the Police Department is prepared for at the Rabies Clinic being held Saturday, January 15th 2011. Councilmember Cecala volunteered to organize the public prior to entering the Clinic.

Mrs. Dugan reported that Dr. Werner is prepared for the Rabies Clinic and will have sufficient vaccine.

Old Business

Animal Control Contract

Mrs. Dugan and Members discussed the Denville Animal Control contract with Mr. Samara and Councilmember Fu. The monthly reporting process and its procedures were addressed.

New Business

Flu Symptoms

Mr. Samara reported that there has been an outbreak of a flu type illness at a Morris Plains facility.

Mr. Samara reported that inspections of the cafeteria found it to be in order. Mr. Samara stated that he was accompanied by Ms. Dolan, RN. Information regarding the importance of hand washing was delivered.

The 2010 dog and cat census found over 200 unlicensed animals within the Borough. Summonses were issued.

The Municipal Alliance Lunch & Learn on Medicare Reform was well attended by approximately 60 seniors.

At the Borough’s Reorganization Meeting Mark Wintel of the Morris Minute Men was recognized for being named National EMT of the Year as well The Minute Men and Borough School retiring teachers were also honored. Mayor Druetzler and Councilmember recognized Bob Heiser for his 32 years of dedicated service and tireless efforts.

Correspondence and Bills

Mrs. Dugan stated that she is in receipt of the NJ Local Boards of Health membership invitation. Mrs. Dugan stated that she will discuss the application with Mr. Heiser.

Mrs. Dugan reported that the Philadelphia Eye Institute is interested in conducting eye exams at the Borough’s Wellness Clinic. Mrs. Dugan will follow up with the institute and report at a future meeting.

Dr. Fenimore stated that the Lyons Club also does eye screening.

There being no further business, Mrs. Marshall moved to adjourn the meeting, seconded by Mrs. Nelson. Voice vote. All in favor.
