Minutes of the Conference Meeting of the Borough Council held April 21, 2011, at 7:30 p.m. in the Council Chambers, Borough Hall, 531 Speedwell Avenue, Morris Plains, New Jersey.

DISCUSSION ITEMS Mayor Druetzler advised that he spoke with Justin Connolly, who resides at the corner of Sylvan Drive and Trowbridge Road, relative to purchasing a small parcel in the vicinity of the cul-de-sac.  It is approximately 4,000 square feet and also abuts Parsippany.  The value of the parcel needs to be determined and the contiguous owners should be asked if they are interested in purchasing it.   Councilmembers were in agreement. 
Mayor Druetzler advised that the work done on Route 53 and Route 10 included tree replanting.  The application is being handled by the Shade Tree Commission.   
Councilmember Fu reported that the Municipal Alliance is working with the County on a program entitled, “Parents Who Host, Lose The Most.”  It advises against the dangers of serving alcohol on your property to minors.  Banners and signs can be posted in front of residences and on public buildings during the prom and graduation period.  Mayor and Council were in agreement to allow placement of the signage, as long as approval is received from the Zoning Officer.  Councilmember Fu added that she will contact Don Salerno to discuss.   
Mayor Druetzler advised that the brick steps at the Teen Center look good and recommended that the porch get done next.   
Councilmember Karr discussed keeping track of employees who are in, absent, at a seminar, on vacation, etc. on a weekly or monthly basis.   It will be coordinated with the Clerk and the Department Heads.   
Mayor Druetzler advised that the Girls Soccer Team will be attending this evening’s meeting as they are champions of the Mayor’s Cup. 

EXECUTIVE SESSION

 Moved by Councilmember Coogan:               BE IT RESOLVED THAT Resolution No. 2011-59 entitled, “Executive Session” be adopted.   
Seconded by Councilmember Cecala.  So ordered.    
Councilmember Karr moved to adjourn the meeting at 8:00 p.m.

APPROVAL OF MINUTES Councilmember McCluskey moved:

 BE IT RESOLVED that the minutes of the Budget Meeting of March 25, 2011 be approved. Seconded by Councilmember Zabihach.  So ordered.  

Councilmember McCluskey moved: BE IT RESOLVED that the minutes of the Executive, Conference and Regular Meeting of April 7, 2011 be approved. Seconded by Councilmember Coogan.  So ordered.   

APPROVAL OF CONSENT CALENDAR

BE IT RESOLVED by the Mayor and Council of the Borough of Morris Plains, that the attached reports be accepted and that said reports be kept on file in the Clerk’s Office:

BE IT FURTHER RESOLVED THAT Resolution No. 2011-60 entitled, “REFUND OF OVERPAYMENT,” be adopted as attached. 

THAT Resolution No. 2011-61 entitled, “CANCELLATION OF REFUND OF TAXES BLOCK 141, LOT 31,” be adopted as attached. 

THAT the Veterans of Foreign Wars, Watnong Post 3401, be granted permission to distributed Little Red Buddy Poppies at various locations within the Borough of Morris Plains from May 1st through May 31st 2011.

 THAT the Fire Department Ladies Auxiliary be granted permission to hold a Mother’s Day Plant Sale on the Fire House ramp, Saturday, May 7th 2011 from 8:00 A.M. until 2:00 P.M.

THAT the Mayor be and he hereby authorizes Leon C. Hall, current Borough Stormwater Program Manager and Borough Engineer, as the duly authorized representative to prepare and submit the Annual Stormwater Report and Certification for 2010. 

THAT Beth Shepard be hired for the Recreation program “Kids Helping Kids”/Ready! Set! Run! Instructor at $30.00 per hour effective May 2nd 2011; which mentor program is authorized through Grant and Registration [The program is self funded]. 

THAT the Borough Treasurer be authorized to advertise for the receipt of bids for Computer Consulting Support and Maintenance Services to the Morris Plains Police Department and Borough Administrative Offices, with bids to be received on Tuesday, June 7th 2011, up to 10:00 A.M., in the Council Chambers. 

THAT having received bids for the Fireworks Display Services, that a contract be awarded to Pyro Engineering D/B/A Bay Fireworks for their low responsible and responsive bid of $20,800.00, and authorizing the Mayor and Clerk to execute the necessary contract in the form approved by the Borough Attorney. 

THAT having received bids for the Speedwell Avenue Improvements, that a contract be awarded to Jo Med Contracting Corporation for their low responsible and responsive bid of $112,178.00, and authorizes the Mayor and Clerk to execute the necessary contract in the form approved by the Borough Attorney. 

THAT having received bids for the Layer Drive, Harrison Avenue, Old Wood Road Drainage, Morris Plains Avenue Sidewalk, Watnong Drive Sidewalk, Littleton Road Sidewalk and Municipal Parking Lot # 1 Improvements, that a contract, Alternate B, be awarded to DLS Contracting, Inc. for their low responsible and responsive bid of $292,850.00, and authorizes the Mayor and Clerk to execute the necessary contract in the form approved by the Borough Attorney. 

THAT the Borough Council approve the membership application of Anthony Barlotta, 35 Sun Valley Way, Morris Plains NJ, as a member of the Morris Plains Junior Fire Auxiliary. 

THAT the Borough Council approve the membership application of Lawrence “Robert” Keller, 44 Winding Way, Morris Plains NJ, as a member of the Morris Plains Junior Fire Auxiliary. 

THAT the Mayor and Clerk be and they hereby are authorized to execute a Developer’s Agreement with ACP Morris Plains, LLC in the form approved by the Borough Attorney. 

THAT the Fire Department be granted permission to hold a Car Wash Fundraiser, on the Fire House ramp on Sundays during the months of May through November 2011, from 8:00 A.M. to 4:00 P.M.

Seconded by Councilmember Zabihach. 

Mayor Druetzler explained to the public that items on the Consent Calendar are routine items grouped together and voted on with one vote instead of voting on each individual item.

GREETING OF PUBLIC AND INVITATION FOR DISCUSSION 

Mayor Druetzler opened the meeting to the public.   

Girls Soccer Team – Mayor’s CupCoach Bob O’Brien provided a brief history of the Girls Soccer program.  He provided details of the final game, adding that it was a tough win.  The game was tied one-to-one, and Melinda, # 16 and present here tonight, put in the winning goal.  Coach O’Brien added that the team came together and they are happy to be here.  The girls introduced themselves and presented the Mayor’s Cup.  Mayor Druetzler said it was an exciting game and the players were excellent.  He thanked the coaches for volunteering.  Mayor Druetzler stated that the Mayor’s Cup and picture would be placed in the trophy case.  Mayor Druetzler presented the team with a gift certificate to Friendly’s.   

Dan Kantor, Sun Valley Way resident, stated he is on the Traffic Committee and discussed a potential sidewalk project with Mayor and Councilmembers and the Borough Engineer.   

Frank Mangravite, 35 Janeway Place resident, continued the topic of a potential sidewalk project, costs, a bike path, and JCP&L’s tree trimming project with Mayor and Councilmembers.   

Hearing no one else, Mayor Druetzler closed the public hearing.   

REPORTS OF COMMITTEES AND/OR DEPARTMENT HEADS

Finance

Councilmember Karr stated that the Morris Plains Library will be holding a shredding fundraiser on Saturday, April 23, 2011.  There will be a $5.00 fee per box and the funds will go to replacing their copier and the summer petting zoo. Councilmember Karr reported that School Board elections will be held on April 27, 2011 at the Community Center from 2:00 p.m. to 9:00 p.m. Councilmember Karr advised that the webmaster informed him that there are over 800 people signed up for e-mail alerts.  The list is growing daily and alerts are sent out as far as Utah.   Councilmember Karr reported that the 2010 Audit has been completed.  

Public Safety

Councilmember Cecala and Chief Scott Thompson reported that the drug take-back program will be held on Saturday, April 30, 2011 from 10:00 a.m. to 2:00 p.m.  Originally it was to be conducted here at Borough Hall, but now the Prosecutor’s Office will be participating and it will be held in the parking lot of Investors Savings Bank.  Notification of the location change has been completed through various websites and Nixle.     

Public Works

Councilmember Coogan stated that the Department of Public Works report was distributed.   In addition to working on the Teen Center, the Department of Public Works is mending the wooden fixtures on the Municipal Building that has started to decay.  Two employees certified to use the mechanical sweeper will be going to a one-day school to learn the proper use and operating conditions of the vehicle, which is offered by the manufacturer. Councilmember Coogan thanked everyone who attended the Community Garden Grand Opening last Saturday, April 16, 2011.  There was a tremendous turnout and there are five people on the waiting list as of this day.   Councilmember Coogan reported that a $500.00 donation was received from the Consumer Products Division of Johnson & Johnson for the Beautification Committee for Earth Day 2011. Councilmember Coogan reported that the process for Open Space applications will now be online. Engineer Hall stated that on April 11, 2011 he attended a DEP stormwater workshop to review new reporting procedures.  The process is now more cumbersome, but he was able to acquire new contacts within the DEP.     

Public Buildings & Grounds

Councilmember McCluskey stated that the Roberts Garden Commission held its first meeting on Monday, April 18, 2011.  They will hold their meetings on the third Monday in April and the third Monday in September.  Other meetings will be scheduled as they become necessary.   Councilmember McCluskey reported that Recreation held its first Summer Camp registration on Monday, April 18, 2011.  The camp begins June 27, 2011 and costs $137 for five weeks ($185 after June 1st).   Councilmember McCluskey reported that the 5K Run will be held on September 8, 2011.   Councilmember McCluskey reported that the Arbor Day Celebration will be held Friday, April 29, 2011, and is sponsored by the Shade Tree Commission at Mountain Way School.    

Public Welfare, Sanitation & Sewers

Councilmember Fu advised that the Teen Center will hold an 8th Grade House event for their last House event on April 29, 2011.  Councilmember Fu added that the Board will be happy with the timely improvements to the Teen Center made by the Department of Public Works.   Councilmember Fu advised that the Municipal Alliance received approval for the supplemental grant for the full $2,500.00.  They are planning a Senior Lunch and Learn, tentatively scheduled for Monday, May 16, 2011.  The topic will be “Lengthening Your Life” and the speaker is Angel Duncan.  DARE’s graduation will be held May 26, 2011.   Councilmember Fu stated that the Recycling Committee met last night, April 20, 2011, and they expressed concern that items are being left at the Recycling Center that do not belong there and other items are put in the wrong place.  They are hopeful that placing additional signage and securing the lock will help keep the situation under control.    

Ordinance & Public Utilities

 Councilmember Zabihach advised that the Planning Board did not meet recently and he will report on their activity at the next meeting. Councilmember Zabihach reported that JCP&L has put out their second contract for tree trimming.  Lewis Tree from Pennsylvania has been contracted to complete the north-western section of Morris Plains by the Recycling Center.  Councilmember Zabihach stated representatives of the New Jersey Department of Transportation met with Donald Salerno, Zoning Officer, to discuss upcoming ADA walkway compatibility improvements in front of Friendly’s and Morris Plains Presbyterian Church.   Councilmember Zabihach stated that the Board of Adjustment will be meeting this Monday, April 25, 2011 and there are two items on the agenda.     

PRESENTATION OF COMMUNICATION, PETITIONS, ETC. 

Mayor Druetzler opened the meeting to the public.

 Hearing no one, Mayor Druetzler closed the public portion.  

ORDINANCES OF FIRST READING Councilmember Zabihach introduced the following ordinance and read the same by title and moved that it be passed on first reading. ORDINANCE # 6 - 2011BOND ORDINANCE APPROPRIATING $210,000, AND AUTHORIZING THE ISSUANCE OF $195,000 BONDS OR NOTES OF THE BOROUGH, FOR VARIOUS IMPROVEMENTS OR PURPOSES AUTHORIZED TO BE UNDERTAKEN BY THE BOROUGH OF MORRIS PLAINS, IN THE COUNTY OF MORRIS, NEW JERSEY. 

Councilmember McCluskey seconded the motion. 

Mayor Druetzler stated that this ordinance allows us to purchase a dump truck and small lots on Watnong Avenue for open space, to improve Speedwell Avenue between Academy Road and Morris Plains Avenue, and to install new lights.

NOW, THEREFORE, BE IT RESOLVED at a meeting to be held on May 5, 2011 at 8:30 P.M. prevailing time in the Municipal Building in the said Borough, this Council will further consider for second reading and final passage of said ordinance.            

AND BE IT FURTHER RESOLVED that the Clerk of this Borough be and she is hereby directed to publish the proper notice therefore, including the ordinance, post the ordinance on the Bulletin Board in the Municipal Building and make copies available to members of the general public. 

Councilmember Karr seconded the resolution.  All in favor.    

Councilmember Zabihach introduced the following ordinance and read the same by title and moved that it be passed on first reading. ORDINANCE NO. 7-2011AN ORDINANCE TO PROVIDE FOR THE PARTIAL AMENDMENT, SUPPLEMENTATION AND REVISION OF CHAPTER 17, ENTITLED PERSONNEL PRACTICES, OF THE “REVISED ORDINANCES OF THE BOROUGH OF MORRIS PLAINS, NEW JERSEY, 1972” INCLUDING CERTAIN PROVISIONS RELATING TO ARTICLE 1, ANNUAL VACATIONS, ARTICLE 2, HOLIDAYS, ARTICLE 3, LEAVES OF ABSENCE, ARTICLE 4, HOURS OF WORK, ARTICLE 8, LONGEVITY, ARTICLE 9, PERSONAL DAYS, ARTICLE 11, DISCIPLINARY POLICY. 

Councilmember Karr seconded the motion. 

Mayor Druetzler stated that these changes will be reflected in the Personnel Policies & Procedures Manual as they need to be updated periodically.
