Minutes of the Conference Meeting of the Borough Council held May 19, 2011, at 7:30 p.m. in the Council Chambers, Borough Hall, 531 Speedwell Avenue, Morris Plains, New Jersey. 
Mayor Druetzler called the meeting to order and read the following notice: I HEREBY ANNOUNCE AND STATE THAT ADEQUATE NOTICE OF THIS MEETING WAS PROVIDED BY VIRTUE OF A RESOLUTION SCHEDULING THE TIME, DATE, AND PLACE OF MEETINGS OF THE BOROUGH COUNCIL OF THE BOROUGH OF MORRIS PLAINS FOR THE YEAR 2011; WHICH RESOLUTION WAS ADOPTED BY THE BOROUGH COUNCIL ON JANUARY 6TH 2011, AND WAS PUBLISHED IN THE MORRIS NEWSBEE AND IN THE DAILY RECORD AND BY THE FORWARDING OF SUCH RESOLUTION TO ALL PERSONS ON THE REQUEST LIST; BY THE POSTING OF SUCH RESOLUTION ON THE BULLETIN BOARD IN THE BOROUGH HALL; ALL OF THE ABOVE ACTIONS BEING IN ACCORDANCE WITH N.J.S.A. 10:4-6, ET SEQ.

DISCUSSION ITEMS Mayor Druetzler reminded that the Morris County Freeholders will be holding a meeting here Wednesday, May 25, 2011 at 7:30 p.m.  Questions you would like the Freeholders to address can be submitted in writing to the Borough Clerk and she will pass them on. 
Mayor Druetzler advised that the three Ordinances introduced at the meeting on May 5, 2011 will need to be tabled as the Newsbee did not publish them.  A special meeting will be held on May 26, 2011 at 8:30 p.m. for second reading.   
Mayor Druetzler advised that the Borough accepted Al Adams’ resignation as Tax Assessor.  We will be looking for opportunities for shared services as this position needs to be filled by the end of June.  
Councilmember McCluskey advised that Phil Forbes has been hired as the new Facilities Coordinator and is getting trained by Bob Beller.  A farewell get-together will be held on Wednesday, May 24, 2011 from 9:30 a.m. to 11:30 a.m.
Mayor Druetzler advised that he, Gail Fraser, Borough Attorney, Kip Falcon, Planning Board Attorney, and Bill Denzler, Borough Planner, met with Ed Buzak, Special Counsel, to discuss strategy for COAH Obligations.  No action is being planned at this time. 
Mayor Druetzler advised that John Hoover, President of the Madison Board of Health, was present at the last Morris Plains Board of Health meeting. Gail Fraser, Borough Attorney, will be composing correspondence requesting additional information. 
Councilmember Cecala advised that Dave Schulz of the Morris Minutemen will be attending this evening’s meeting to discuss a five year plan, which will include budgeting for vehicle and equipment needs.    
   

EXECUTIVE SESSION

 Moved by Councilmember Cecala:               BE IT RESOLVED THAT Resolution No. 2011-67 entitled, “Executive Session” be adopted.  
Seconded by Councilmember Zabihach.  So ordered.

Mayor Druetzler advised that Councilmember Coogan will not be attending this meeting this evening.  

PRESENTATIONBeautification Award Sue McArdle, President of the Beautification Committee, presented Alice McGreevy of Arthur’s Restaurant the 2011 Beautification Award.  They created a wonderful garden area adjacent to their restaurant.  Ms. McArdle added that they are a wonderful neighbor and appreciates that they take pride in their appearance.  Ms. McGreevy offered heartfelt gratitude.    

APPROVAL OF MINUTES Councilmember McCluskey moved: BE IT RESOLVED that the minutes of the Executive, Conference and Regular Meeting of April 21, 2011 be approved.

APPROVAL OF CONSENT CALENDAR Councilmember McCluskey moved:

BE IT FURTHER RESOLVED THAT having received quotes for the MP Family Day from the following:

THAT a purchase order be issued to Party Perfect, in the amount of $4,800.00. 

THAT Philip Forbes, 34 Winding Way be hired for the Community Center Facilities Coordinator at $19.00 per hour effective May 17th 2011. 

THAT Anna Brockman, 25 Diana Road be granted permission to serve alcoholic beverages at a Graduation Party to be held Saturday, May 21st 2011, from 11 A.M. to 6:00 P.M., at Community Park. 

THAT Jerry Brophy, 17 Watnong Drive be granted permission to serve alcoholic beverages at a Picnic to be held Saturday, June 18th 2011, from 11 A.M. to 5:00 P.M., at Community Park.

THAT the Borough Clerk publish notice of a Special Meeting of the Borough Council to be held Thursday, May 26th 2011, at 8:30 P.M. in Council Chambers for the purpose of adopting ordinances and any other business matters. Seconded by Councilmember Zabihach. Mayor Druetzler announced that a special meeting will be held on Thursday, May 26, 2011 because the Newsbee did not publish the Ordinances that were introduced on May 5, 2011.   The public hearings on Adoption will be held on May 26, 2011.

GREETING OF PUBLIC AND INVITATION FOR DISCUSSION Mayor Druetzler opened the meeting to the public.   Dave Schulz of the Morris Minutemen introduced other members on the squad.  He discussed the Minutemen’s five year goals.  He discussed the squad’s vehicle and equipment needs. Hearing no one else, Mayor Druetzler closed the public hearing.   

REPORTS OF COMMITTEES AND/OR DEPARTMENT HEADS

Finance

Councilmember Karr stated that software will be updated by tomorrow so the Tax Office and Finance Office will be compatible and can be used by both offices.   Cross-training is continuing. Chief Scott Thompson reported the e-tickets is not up and running yet and is waiting to be tested by the vendor.   Councilmember Karr advised that the Library changed their hours to Tuesdays and Thursdays 10 a.m. to 7 p.m., Wednesdays and Fridays 10 a.m. to 5 p.m., and Saturdays 10 a.m. to 2 p.m.  

Public Safety

Councilmember Cecala reported that ground was broken last Saturday, May 14, 2011 for the 9-11 Memorial.  Everything is progressing smoothly. Chief Scott Thompson provided a report on Police Department activities.    

Public Works

Leon Hall, Borough Engineer, advised that contracts will be signed and construction meetings will be scheduled.    

Public Buildings & Grounds

 Councilmember McCluskey reported on behalf of Councilmember Coogan that the Governor declared this week Public Works week in the State of New Jersey.   Councilmember McCluskey reminded that the Memorial Day Parade will be held on May 28, 2011.    

Public Welfare, Sanitation & Sewers

 Councilmember Fu advised that the Municipal Alliance held a Senior Lunch and Learn on Monday, May 16, 2011.  It was well attended by approximately 50 seniors.  Good reviews were received on the speaker and the food.   Councilmember Fu advised that the Board of Health met Wednesday, May 11, 2011, and the Madison Board of Health President, John Hoover, attended the meeting.  He advised that interviews are being conducted this week for the position of Health Officer.  It is their hope to have someone hired by the end of May.  Wellness Day will be held on October 15, 2011 and they are hoping to have the Flu Clinic on the same date.  They are trying to think of ways to increase attendance for Wellness Day by offering more services. Councilmember Fu stated that the Teen Center held a bingo activity for the 6th, 7th and 8th graders last Friday, May 13, 2011.  Attendance was low, and they believe it was because of the number of activities that were held that evening.  

Ordinance & Public Utilities

Councilmember Zabihach stated that the Planning Board met this past Monday, May 16, 2011.  The Chase application remains incomplete. Councilmember Zabihach stated that the Board of Adjustment will meet next Monday, May 23, 2011.     

PRESENTATION OF COMMUNICATION, PETITIONS, ETC. 

Mayor Druetzler opened the meeting to the public. Hearing no one, Mayor Druetzler closed the public portion.   

ORDINANCES OF FIRST READING Councilmember Zabihach introduced the following ordinance and read the same by title and moved that it be passed on first reading. 

ORDINANCE 11-2011AN ORDINANCE PROVIDING FOR THE PARTIAL AMENDMENT AND SUPPLEMENTATION OF SECTION 22-7, “STOP INTERSECTIONS,” IN CHAPTER 22, “TRAFFIC AND PARKING,” OF THE "REVISED ORDINANCES OF THE BOROUGH OF MORRIS PLAINS, NEW JERSEY, 1972” TO DESIGNATE IDLEWILD DRIVE AT WASHINGTON AVENUE AS A NEW STOP INTERSECTION. 

Councilmember Cecala seconded the motion. Mayor Druetzler stated that this ordinance was recommended by the Traffic Committee and the Chief of Police.

 Thereupon, Councilmember Zabihach offered the following resolution:             WHEREAS, the above ordinance was introduced and read by title at this meeting on May 19, 2011 and passed on first reading.            

NOW, THEREFORE, BE IT RESOLVED at a meeting to be held on June 16, 2011 at 8:30 P.M. prevailing time in the Municipal Building in the said Borough, this Council will further consider for second reading and final passage of said ordinance.            

AND BE IT FURTHER RESOLVED that the Clerk of this Borough be and she is hereby directed to publish the proper notice therefore, including the ordinance, post the ordinance on the Bulletin Board in the Municipal Building and make copies available to members of the general public. 

Councilmember Karr seconded the resolution.  All in favor.     

ORDINANCES ON SECOND READING 

Councilmember Zabihach made a motion to table the following ordinances: 

ORDINANCE 8-2011BOND ORDINANCE APPROPRIATING $210,000, AND AUTHORIZING THE ISSUANCE OF $195,000 BONDS OR NOTES OF THE BOROUGH, FOR VARIOUS IMPROVEMENTS OR PURPOSES AUTHORIZED TO BE UNDERTAKEN BY THE BOROUGH OF MORRIS PLAINS, IN THE COUNTY OF MORRIS, NEW JERSEY. 

ORDINANCE NO. 9-2011AN ORDINANCE AMENDING ORDINANCE NO. 14-2010 CONCERNING COMPENSATION FOR RECREATION DIRECTOR AND CREATING RECREATION COORDINATOR POSITION 

ORDINANCE NO. 10-2011AN ORDINANCE ACCEPTING A PERPETUAL CONSERVATION EASEMENT DEDICATED AND CONVEYED TO THE BOROUGH OF MORRIS PLAINS ON BLOCK 171, LOTS 39, 40, 41 & 42 (N/K/A BLOCK 171, LOT 39) IN THE BOROUGH OF MORRIS PLAINS.                     

WHEREAS, the above ordinance was introduced and read by title at this meeting on May 5, 2011 and passed on first reading.            

NOW, THEREFORE, BE IT RESOLVED at a meeting to be held on May 26, 2011 at 8:30 P.M. prevailing time in the Municipal Building in the said Borough, this Council will further consider for second reading and final passage of said ordinance.

RESOLUTIONS

Moved by Councilmember McCluskey:              

BE IT RESOLVED THAT Resolution No. 2011-68 granting permission to St. Virgil to hold its Field Day activities at Simons Park on Friday, May 20th 2011, with a rain date of Monday, May 23rd 2011 from 9:00 a.m. to 11:00 a.m.” be adopted.   

 Seconded by Councilmember Zabihach. 

Councilmember Karr abstained.  So ordered.   

Moved by Councilmember McCluskey:              

 BE IT RESOLVED THAT Resolution No. 2011-69 authorizing the attached be hired for the 2011 Summer Pool season at the position and salary stated, effective June 1st 2011” be adopted.   

 Seconded by Councilmember Zabihach. 

Councilmembers Karr and Cecala abstained.  So ordered.   

Mayor Druetzler explained that the abstentions are necessary due to potential conflict as there are family members of these councilmembers involved with the named organizations.
