Regular Council Meeting Minutes 12/29/11

Minutes of the Conference Meeting of the Borough Council held December 29, 2011, at 7:30 p.m. in the Council Chambers, Borough Hall, 531 Speedwell Avenue, Morris Plains, New Jersey. 
Mayor Druetzler called the meeting to order and read the following notice: 
I HEREBY ANNOUNCE AND STATE THAT ADEQUATE NOTICE OF THIS MEETING WAS PROVIDED BY VIRTUE OF A RESOLUTION SCHEDULING THE TIME, DATE, AND PLACE OF MEETINGS OF THE BOROUGH COUNCIL OF THE BOROUGH OF MORRIS PLAINS FOR THE YEAR 2011; WHICH RESOLUTION WAS ADOPTED BY THE BOROUGH COUNCIL ON JANUARY 6TH 2011, AND WAS PUBLISHED IN THE MORRIS NEWSBEE AND IN THE DAILY RECORD AND BY THE FORWARDING OF SUCH RESOLUTION TO ALL PERSONS ON THE REQUEST LIST; BY THE POSTING OF SUCH RESOLUTION ON THE BULLETIN BOARD IN THE BOROUGH HALL;
 ALL OF THE ABOVE ACTIONS BEING IN ACCORDANCE WITH N.J.S.A. 10:4-6, ET SEQ.

DISCUSSION ITEMS 
Mayor Druetzler asked if anyone had comments relative to the Consent Calendar.  He referenced three tax appeals and new hires for Kids Helping Kids Programs. 
Mayor and Councilmembers recognized Councilmember Joe Cecala, Jr. and expressed their appreciation for the contributions he has made to the Governing Body. 
 Councilmember Cecala reflected on fond memories while serving on Borough Council since 2003. 

EXECUTIVE SESSION

Moved by Councilmember Coogan:              
BE IT RESOLVED THAT Resolution No. 2011-146 entitled, “Executive Session” be adopted.   
Seconded by Councilmember Zabihach.  So ordered.   
Councilmember McCluskey moved to adjourn the meeting at 8:29 p.m.

Mayor Druetzler called the meeting to order and read the following notice:

 APPROVAL OF MINUTES Councilmember McCluskey moved: BE IT RESOLVED that the minutes of the Executive, Conference and Regular Meeting of December 1, 2011 be approved. Seconded by Councilmember Zabihach.

APPROVAL OF CONSENT CALENDAR Councilmember McCluskey moved: 

BE IT RESOLVED by the Mayor and Council of the Borough of Morris Plains, that the attached reports be accepted and that said reports be kept on file in the Clerk’s Office: 

REPORTS None.

 BE IT FURTHER RESOLVED THAT Resolution No. 2011-147 entitled, “CANCEL UNEXPENDED 2011 BUDGET APPROPRIATION BALANCE,” be adopted as attached. 

THAT Resolution No. 2011-148 entitled, “APPROVING SETTLEMENT ON APPEAL FROM ASSESSMENT BOROUGH OF MORRIS PLAINS adv REALTY INCOME CORP. BLOCK 23, LOT 5 – 435 SPEEDWELL AVENUE, DOCKET NOS. 01156-2009, 013766-2010, 012999-2011” be adopted as attached. 

THAT Resolution No. 2011-149 entitled, “APPROVING SETTLEMENT ON APPEAL FROM ASSESSMENT BOROUGH OF MORRIS PLAINS adv ANTHONY GALDI AND ADELINA PALMA GALDI BLOCK 71, LOT 3 – 65 GRANNISS AVENUE, DOCKET NOS. 010380-2010, 003712-2011” be adopted as attached. 

THAT Resolution No. 2011-150 entitled, “APPROVING SETTLEMENT ON APPEAL FROM ASSESSMENT BOROUGH OF MORRIS PLAINS adv TED THUEN BLOCK 63, LOT 19– 740-752 SPEEDWELL AVENUE, DOCKET NOS. 008732-2009, 010211-2010, 001525-2011” be adopted as attached. 

THAT Darlene Howell be hired for the Recreation program “Kids Helping Kids” Reading Instructor at $50.00 per hour effective January 17th 2012; which mentor program is authorized through a Grant and Registration [The program is self funded]. 

THAT Lorey Canning be hired for the Recreation program “Kids Helping Kids” Reading Instructor at $50.00 per hour effective January 17th 2012; which mentor program is authorized through a Grant and Registration [The program is self funded]. 

THAT the Borough Council approve the JP Morgan Chase Bank sewer connection fee of $3,360.00 for 573-599 Speedwell Avenue as per the Borough Engineer’s correspondence of September 7, 2011.

 GREETING OF PUBLIC AND INVITATION FOR DISCUSSION 

Mayor Druetzler opened the meeting to the public.   Councilmember McCluskey introduced members of her family that were present this evening:  Her daughter, Megan, and her husband, Rich, and their children, Thomas, Wiss, Timothy and Lottie; her son Brendan McCluskey and his wife, Christine, and their children Roisin and Maebh; and her son Tim and daughter-in-law Kellen, and their children Miele, Calla and Varenna.  Tim McCluskey stated that he is a Council President in Centreville, Maryland, a town of approximately 4,200 residents.  He said it was nice to see how municipal government works in this area. Seeing no one else, Mayor Druetzler closed the public hearing.     

REPORTS OF COMMITTEES AND/OR DEPARTMENT HEADS

Finance

 Councilmember Karr stated that he and Councilmember Coogan met with the Department of Public Works to begin contract negotiations.   Another meeting is scheduled for January 17, 2012.   David Banks, CFO, is receiving recommended budgets from departments and they are being reviewed.   He thanked Councilman Cecala for his time and dedication to the Borough.  

     

Public Safety

 Councilmember Cecala stated he did not have a report, however, he spoke of his appreciation for the Police Department and Fire Department. Chief Thompson stated that he has been selected to attend the FBI National Academy in Virginia for 10 weeks of training beginning in January 2012 and returning in March 2012.   Mayor Druetzler proudly stated that Chief Thompson will be the first member of the Morris Plains Police Department to be attending the FBI National Academy.  This is very significant for the Chief to be accepted to this rigorous program as he has met all of the requirements to qualify.  

Public Works

 Councilmember Coogan stated that leaf collection continues as well as another round of brush collection.  The DPW is also working on the parks and doing maintenance on the public buildings.

     

Public Buildings & Grounds

 Councilmember McCluskey stated she does not have a report for Public Buildings and Grounds.  However, as she will be the Chair of Public Safety, she extended appreciation to Councilman Cecala for having it in fine order.    

 

Public Welfare, Sanitation & Sewers

 Councilmember Fu reminded everyone that the Rabies Clinic will take place on Saturday, January 14, 2012 from 1:00 to 3:00 p.m. at the Public Works Garage.    

Ordinance & Public Utilities

 Councilmember Zabihach stated that he does not have a report, however, he wanted to express that it was a pleasure working with Councilman Cecala.  He wished everyone present a Happy and Health New Year.

Mayor Druetzler opened the meeting to the public. Hearing no one, Mayor Druetzler closed the public portion.

ORDINANCES ON SECOND READING 

Councilmember Zabihach read by title the ordinance entitled: 

ORDINANCE NO. 20-2011

AN ORDINANCE AMENDING, SUPPLEMENTING AND REVISING THE REGULATIONS SET FORTH IN CHAPTER 28, ENTITLED “DEER CULLING PROGRAM” IN THE "REVISED ORDINANCES OF THE BOROUGH OF MORRIS PLAINS, NEW JERSEY, 1972.”

which ordinance was introduced and passed on first reading at a meeting held on December 15, 2011.The Clerk read the following notice: 

Notice is hereby given that the following ordinance was submitted in writing at a meeting of the Mayor and Borough Council of the Borough of Morris Plains on December 15, 2011, introduced and read by title and passed on first reading, and that the said Governing Body will further consider the same for second reading and final passage thereof at a regular meeting beginning at 8:30 P.M., on December 29, 2011 at the Borough Hall, 531 Speedwell Avenue, Morris Plains, New Jersey, in said Borough at which time and place a public hearing will be held thereon by the Governing Body and all parties in interest and citizens and all persons shall have an opportunity to be heard concerning said ordinance. 

Councilmember Zabihach read the following notice and ordinance by title and stated that the Notice and Ordinance had been published as required by law that the ordinance had been posted on the bulletin board in the Municipal Building and that copies had been made available to members of the general public. 

Mayor Druetzler announced that the meeting was open for a public hearing on the ordinance and stated that any taxpayer of the Borough of Morris Plains and all parties and persons in interest and citizens may be heard.  

Mayor Druetzler stated that Ordinance updates our deer culling requirements. 

Seeing no one, Mayor Druetzler closed the Public Hearing. 

Thereupon Councilmember Zabihach offered the following Resolution and moved its adoption: 

RESOLVED, That the above ordinance as read by title on Second Reading, at this meeting, be adopted and finally passed. 

Councilmember Cecala seconded the motion. 

Mayor Druetzler ordered the Clerk to call the roll on the passage thereof and the vote was as follows:

 ORDINANCE #_21-2011__

AN ORDINANCE TO APPROPRIATE $50,000.00 FROM THE CAPITAL IMPROVEMENT FUND FOR THE IMPROVEMENTS TO BE UNDERTAKEN BY THE BOROUGH OF MORRIS PLAINS, IN THE  COUNTY OF MORRIS,  STATE OF NEW JERSEY 

which ordinance was introduced and passed on first reading at a meeting held on December 15, 2011.The Clerk read the following notice:

AN ORDINANCE ESTABLISHING PAY GRADES AND FIXING SALARIES AND BENEFITS

FOR THE POLICE DEPARTMENT OF THE BOROUGH OF MORRIS PLAINS

 which ordinance was introduced and passed on first reading at a meeting held on December 1, 2011.

The Clerk read the following notice: 

Notice is hereby given that the following ordinance was submitted in writing at a meeting of the Mayor and Borough Council of the Borough of Morris Plains on December 15, 2011, introduced and read by title and passed on first reading, and that the said Governing Body will further consider the same for second reading and final passage thereof at a regular meeting beginning at 8:30 P.M., on December 29, 2011 at the Borough Hall, 531 Speedwell Avenue, Morris Plains, New Jersey, in said Borough at which time and place a public hearing will be held thereon by the Governing Body and all parties in interest and citizens and all persons shall have an opportunity to be heard concerning said ordinance.

Mayor Druetzler stated that this Ordinance represents negotiations for a three year contract with the Police Department. 

Seeing no one, Mayor Druetzler closed the Public Hearing.  

 Thereupon Councilmember Zabihach offered the following Resolution and moved its adoption: 

RESOLVED, That the above ordinance as read by title on Second Reading, at this meeting, be adopted and finally passed. 

Councilmember Cecala seconded the motion.

Mayor Druetzler announced that Tim McCluskey will be attending this year’s Annual Memorial Day Parade and will be sporting his horse-head.   Mayor Druetzler offered Friendly coupons for the McCluskey family members.
