Minutes of the Conference Meeting of the Borough Council held December 15, 2011, at 5:30 p.m. in the Council Chambers, Borough Hall, 531 Speedwell Avenue, Morris Plains, New Jersey. 
Mayor Druetzler called the meeting to order and read the following notice:

DISCUSSION ITEMS 
Mayor Druetzler requested that the record show all members of the Governing Body are present. Mayor Druetzler asked if anyone had comments relative to the Consent Calendar.  Mayor Druetzler announced that the appointment of Joseph Cecala, Jr. as Deer Cull Coordinator will be recognized at the Annual Reorganization Meeting.   
Mayor and Councilmembers presented Councilman Cecala with a token of appreciation.

 BE IT FURTHER RESOLVED

 THAT Resolution No. 2011-139 entitled, “CANCELLATION OF BALANCES AND OVERPAYMENTS LESS THAN $10.00,” be adopted as attached. 

THAT Resolution No. 2011-140 entitled, “Transfer of Funds” be adopted as attached. 

THAT Resolution No. 2011-141 entitled, “Dedicated Trust by Rider for Morris Plains Municipal Alliance” be adopted as attached. 

THAT the Borough Council authorize the release and return of the one year Maintenance Bond No. 2452MB, Speedwell Avenue sidewalk and lighting improvements to Tony’s Concrete Co., Inc., in the amount of $11,946.75, per the Borough Engineer’s correspondence dated December 9, 2011. 

THAT the Borough Council authorize the release and return of the two year Maintenance Bonds (cash), PB-06-05 in the amount of $11, 087.55 and PB-06-06 in the amount of $11,173.35, to Cole Schotz for American Enterprise Park per the Borough Engineer’s correspondence dated December 13, 2011. 

THAT an Emergency affecting the safety of the public per N.J.S.A. 40A:11-6 has been identified and requires the immediate performance of work and services; the Borough Engineer has received proposals for the immediate removal and replacement of the collapsed culvert and existing headwalls on Sun Valley Way from the following:                        

R & R Construction Co.                   $66,820.20                       

W.J. Harrington & Sons, Inc.           $83,923.00 

THAT a purchase order be issued to R&R Construction Co., in the amount of $66,820.00.

 THAT the Mayor and Clerk be and they are hereby authorized to execute the Agreement between the Borough of Morris Plains and the P.B.A. Local #254, January 1, 2012 through December 31, 2014.

GREETING OF PUBLIC AND INVITATION FOR DISCUSSION 

Mayor Druetzler opened the meeting to the public.   

Chris Gardner offered a Proclamation declaring Mayor Frank “Tamborine Man” Druetzler the first chair position as principal tamborinest.  Mayor Druetzler was presented with an official tambourine.

 Seeing no one else, Mayor Druetzler closed the public hearing.     

 

REPORTS OF COMMITTEES AND/OR DEPARTMENT HEADS

Finance

 Councilmember Karr stated that the Consent Calendar lists a Resolution for the Transfer of Funds, which is needed to cover overtime incurred by the Police Department.    

Public Safety

 Councilmember Cecala stated that the deer cull totals include nine deer taken from midge bites; five culled on Sunset Road, Sun Valley Way, and Briarcliff each; two culled at Community Park; seven at Central Avenue; two at Court Road and Tower Hill Road each, and three at the Recycling Center, for a total of  40 deer.   Chief Thompson stated that Sergeant Michael Koroski graduated from the New Jersey State Association of Chiefs of Police Leadership and Command Academy Class, formerly known as West Point.  It is a rigorous 14 week intensive training program. Chief Thompson stated that he will be leaving on January 8th 2012 and returning March 16th 2012.  He has been invited to attend the FBI National Academy in Virginia. Chief Thompson stated that Detective Jason Kohn and Detective Bruce Rapp took part in a task force in solving a string of violent burglaries.  They are scheduled to be recognized by the Morris County Detective Association luncheon next Tuesday.  Chief Thompson advised that Detective Bruce Rapp has been assigned to the DWI Task Force to man road blocks this Holiday Season.  

Public Works

 Councilmember Coogan stated that the Department of Public Works’ report has been distributed.  They are completing the second round of leaf collection and are now in District 2.  After leaf collection, another round of brush collection will be done.  They also repaired strands of Christmas lights at Rotary Park.  Ed Easse recommended the DPW install new windows at the Annex, which may be a capital project for 2012.    

  Public Buildings & Grounds

 Councilmember McCluskey stated the Recreation Commission met last week and they will be making recommendations for their budget in 2012.  Little League President, Tom Bergeron, and Softball President, Chuck Stiesi, addressed the Commission to identify their needs for the coming year. Councilmember McCluskey advised that the Kids Helping Kids Program will be preparing for a talent show in February 2012 at the Community Center.   Councilmember McCluskey advised that the Model Railroad now has their own website. Councilmember McCluskey advised that the Recreation Commission is still entertaining the idea of Comedy Night for March 2012 at Bretton Woods. 

  

Public Welfare, Sanitation & Sewers

 Councilmember Fu stated that the Board of Health met last night and discussed the Rabies Clinic that will take place on Saturday, January 14, 2012 from 1:00 to 3:00 p.m. at the Public Works Garage.  A meeting will be held with the Police Department to discuss traffic control.   Madison Health Department has secured 300 vaccines.   

Councilmember Fu advised that the Recycling Committee received the enclosed bin at the Recycling Center and it seems to be working very well.  Councilmember Fu attended a Recycling Coordinator’s meeting at the MUA today and advised that shredded paper was addressed. 

Councilmember Fu advised that the Sustainable New Jersey Committee met this week with Dr. Palestis and other school administrators and discussed initiatives the Committee is willing to undertake with them to obtain Certification.  The Board of Education will adopt a Resolution in January to participate in education for sustainability.   

Ordinance & Public Utilities

 Councilmember Zabihach stated that the Planning Board met on Monday, December 12, 2011 and recommended adoption of Ordinance 17-2011 Steep Slopes and Riparian Zones.  Two applications were heard; a Mexican restaurant to be located next to Aji Sushi Restaurant and a jewelry store to be located across the street. 

 The Planning Board discussed ways to make it the process less burdensome for small businesses.

Mayor Druetzler opened the meeting to the public. Hearing no one, Mayor Druetzler closed the public portion.  

 

 ORDINANCES OF FIRST READING 

Councilmember Zabihach introduced the following ordinance and read the same by title and moved that it be passed on first reading. 

ORDINANCE NO. 20-2011

AN ORDINANCE AMENDING, SUPPLEMENTING AND REVISING THE REGULATIONS SET FORTH IN CHAPTER 28, ENTITLED “DEER CULLING PROGRAM” IN THE "REVISED ORDINANCES OF THE BOROUGH OF MORRIS PLAINS, NEW JERSEY, 1972.” 

Councilmember Cecala seconded the motion. Mayor Druetzler stated that this Ordinance is updating current regulations, i.e., must be at least 18 years of age with at least five years experience, and two antlerless deer need to be culled in town prior to culling a deer with antlers.

Councilmember Zabihach introduced the following ordinance and read the same by title and moved that it be passed on first reading. 

ORDINANCE #_21-2011__

AN ORDINANCE TO APPROPRIATE $50,000.00 FROM THE CAPITAL IMPROVEMENT FUND FOR THE IMPROVEMENTS TO BE UNDERTAKEN BY THE BOROUGH OF MORRIS PLAINS, IN THE  COUNTY OF MORRIS,  STATE OF NEW JERSEY 

Councilmember Coogan seconded the motion. 

Mayor Druetzler stated this Ordinance allows us appropriate money for parks and fields.

FOR THE POLICE DEPARTMENT OF THE BOROUGH OF MORRIS PLAINS

Councilmember Karr seconded the motion. 

Mayor Druetzler stated that this Ordinance represents negotiations that were agreed to for this three year contract with the Police Department.

Mayor Druetzler announced that the meeting was open for a public hearing on the ordinance and stated that any taxpayer of the Borough of Morris Plains and all parties and persons in interest and citizens may be heard.  

Mayor Druetzler stated that this is a housekeeping Ordinance that is mandated by the DEP and requested by the County and will have little effect on the Borough.   

Seeing no one, Mayor Druetzler closed the Public Hearing.

Mayor Druetzler stated this Ordinance allows us to make improvements on some Borough owned properties.

Mayor Druetzler stated that these two patrolmen will begin employment on January 16, 2012 and will  be going to the Police Academy thereafter.
