ORDINANCE NO. 3-2010
AN ORDINANCE PROVIDING FOR THE AMENDMENT OF
CHAPTER 18, “POLICE DEPARTMENT,” OF THE "REVISED ORDINANCES OF THE BOROUGH OF MORRIS PLAINS, NEW JERSEY, 1972” WITH THE PARTIAL AMENDMENT, SUPPLEMENTATION AND REVISION OF PARAGRAPH (C)IN SECTION 18-7 “QUALIFICATIONS.”
WHEREAS, the Borough Council adopted Ordinance #10-2003, establishing an educational requirement for promotion to the rank of Lieutenant in the Morris Plains Police Department; and
WHEREAS, as a result of unanticipated retirements, none of the Sergeants in the Morris Plains Police Department satisfy the educational requirement so that the Borough Council currently lacks a pool of eligible candidates to fill an opening for a Lieutenant’s position; and
WHEREAS, the Borough Council wishes to extend the effective date of the educational requirement for promotion to Lieutenant, but the Borough Council remains committed to the educational qualification to ensure an educated and well-rounded police force.
NOW, THEREFORE, BE IT ORDAINED, by the Borough Council of the Borough of Morris Plains, they being the Governing Body thereof, as follows:
Paragraph (c) in Section 18-7, “Qualifications” in Chapter 18 of the Revised Ordinances is hereby partially amended, supplemented and revised by replacing “Effective June 1, 2006,” with “Effective June 1, 2011,” so that it reads, in its entirety, as follows:
(c) Effective June 1, 2011, no person shall be promoted to or hired at the rank of Lieutenant or Captain unless he or she is actively enrolled at an undergraduate institution accredited by the Middle States Association of Colleges and Schools and has obtained at least 90 credits towards a bachelor of arts or science degree from such institution.
All other provisions of the aforesaid Section 1807 and Chapter 18 of the Revised Ordinances shall be unaffected and are hereby continued.
All Ordinances and parts of Ordinances inconsistent herewith are hereby repealed to the extent of such inconsistency.
If any section, subsection, sentence, clause or phrase of this Ordinance is, for any reason, held to be invalid by a Court of competent jurisdiction, such a decision shall not affect the validity of the remaining portions of this Ordinance.
This Ordinance shall take effect immediately after final passage and publication as provided by law.
