ORDINANCE NO. 6-2010

AN ORDINANCE PROVIDING FOR THE PARTIAL AMENDMENT, SUPPLEMENTATION AND REVISION OF ARTICLE 2, "NUMBERING OF BUILDINGS" IN CHAPTER 7, "BUILDINGS AND STRUCTURES," OF THE "REVISED ORDINANCES OF THE BOROUGH OF MORRIS PLAINS, NEW JERSEY, 1972."

WHEREAS, the Borough Council has received a recommendation from the Fire Prevention Official that the display of the numbering of buildings be increased in size to comply with the current requirements of the New Jersey Fire Code; and

WHEREAS, the Borough Council is desirous of amending the Revised Ordinances consistent with the recommendation of the Fire Official, and in a manner that fosters the increased visibility of said numbers to promote public safety.

NOW, THEREFORE, BE IT ORDAINED, by the Borough Council of the Borough of Morris Plains, they being the Governing Body thereof, as follows:

Section l:

Article 2, "Numbering of Buildings," in Chapter 7, "BUIDLINGS AND STRUCTURES" of the Revised Ordinances is hereby amended, supplemented and revised by repealing the existing Section 7-13 "Display of numbers," which reads as follows:

7-13. Display of numbers.

The numbers shall be in figures or in script, not less than two (2) and not more than three (3) inches in height, placed conspicuously on the front of each building or in front of such building in such manner as to be easily discernible from the street.

and replacing it with the following new Section 7-13 "Display of numbers," which shall hereafter read as follows:

7-13. Display of numbers.

The numbers shall be in Arabic numerals or in script, not less than four (4) inches (102mm) in height with a minimum stroke width of one-half (0.5) inch (12.7mm). The numbers shall contrast with their background and be placed conspicuously on the front of each building or in front of such building in such manner as to be easily discernible from the street.

Section 2:

Article 2, "Numbering of Buildings," in Chapter 7, "BUIDLINGS AND STRUCTURES" of the Revised Ordinances is hereby amended, supplemented and revised by repealing the existing Section 7-16 "Failure to comply," which reads as follows:

7-16. Failure to comply.

In cases where the property owner shall have failed to ascertain and affix upon any building the number or numbers applicable to said building as provided in this Article, the Building Inspector shall serve a notice upon the owner, by personal service or by registered or certified mail addressed to his last known address, to affix the required number within three (3) days after receipt of said notice.

and replacing it with the following new Section 7-16 "Failure to comply," which shall hereafter read as follows:

7-16. Failure to comply.

In cases where the property owner shall have failed to ascertain and affix upon any building the number or numbers applicable to said building as provided in this Article, the enforcing authority shall serve a notice upon the owner, by personal service or by registered or certified mail addressed to his last known address, to affix the required number within three (3) days after receipt of said notice.

Section 3:

Article 2, "Numbering of Buildings," in Chapter 7, "BUIDLINGS AND STRUCTURES" of the Revised Ordinances is hereby amended and supplemented with a new Section 7-18 "Enforcement," which reads as follows:

7-18. Enforcement.

This ordinance shall be enforced by the Borough Fire Prevention Official, all Police Officers of the Borough, the Borough Engineer, the Superintendent of the Department of Public Works, the Health Officer, the Construction Official, all code enforcement officers, the Zoning Officer and/or their duly authorized designees.

Section 4:

All other provisions of the aforesaid Chapter 7 of the Revised Ordinances shall be unaffected and are hereby continued.

Section 5:

All Ordinances and parts of Ordinances inconsistent herewith are hereby repealed to the extent of such inconsistency.

Section 6:

If any section, subsection, sentence, clause or phrase of this Ordinance is, for any reason, held to be invalid by a Court of competent jurisdiction, such a decision shall not affect

the validity of the remaining portions of this Ordinance.

Section 7:

This Ordinance shall take effect immediately after final passage and publication as provided by law.
