ORDINANCE NO. 13-2010

 

 

AN ORDINANCE TO PROVIDE FOR THE PARTIAL AMENDMENT, SUPPLEMENTATION, AND REPEAL OF PORTIONS OF SUBSECTION C, ENTITLED "SIGNS IN THE B-1, B-2, B-4 AND C-1 ZONES" AS SET FORTH IN SECTION 13-5.8 OF "CHAPTER 13, 2000 BOROUGH OF MORRIS PLAINS LAND DEVELOPMENT ORDINANCE," SPECIFICALLY THE REVISION OF CERTAIN PROVISIONS RELATING TO WALL SIGNS IN THE C-1 ZONE DISTRICT.

 

WHEREAS, the Borough Council is desirous of amending "Chapter 13, 2000 BOROUGH OF MORRIS PLAINS LAND DEVELOPMENT ORDINANCE" (hereinafter "Chapter 13") to revise certain regulations governing wall signs in the C-1 zone district.

NOW, THEREFORE, BE IT ORDAINED, by the Borough Council of the Borough of Morris Plains, they being the Governing Body thereof, as follows:

Section 1:

Chapter 13, Section 13-5.8C is hereby amended, supplemented and revised by repealing Section (1.2)(a)(i) relating to wall signs in the C-1 zone, which reads as follows:

    1. All such signs shall be uniform in terms of style, height, design and materials.

And renumbering the remaining paragraphs (ii) through (iv), as (i) through (iii).

Section 2:

Chapter 13, Section 13-5.8C(1.2)(f) is hereby amended, supplemented and revised by repealing the phrase "uniform in size and color," so that hereafter, (f) shall read as follows:

    1. The maximum width of any sign shall not exceed fifty percent (50%) of the width of the wall of the establishment to which it is attached, but in no event greater than twenty (20) feet, except for an unlighted or indirectly-lighted wall sign consisting only of painted or raised lettering, not more than twelve (12) inches in height, and applied to a wall or flat wall panel, which may extend to a width of fifty percent (50%) of the width of the wall of the establishment.

Section 3:

Chapter 13, Section 13-5.8C(4) is hereby amended, supplemented and revised by inserting the phrase "in the B-1, B-2 or B-4 zone" after the word "building" in the first sentence, so that hereafter the first sentence of Section 13-5.8C(4) shall read as follows:

(4) If a building in the B-1, B-2 or B-4 zone contains more than one (1) establishment, the signs permitted in Subsection (a) and (b) above shall be uniform in terms of design, color, height of background, style and height of lettering, and position on building wall.

 

Section 4:

All other provisions of "Chapter 13, 2000 Borough of Morris Plains Land Development Ordinance" shall be unaffected and are hereby continued.

Section 5:

All Ordinances and parts of Ordinances inconsistent herewith are hereby repealed to the extent of such inconsistency.

Section 6:

If any section, subsection, sentence, clause or phrase of this Ordinance is, for any reason, held to be invalid by a Court of competent jurisdiction to be invalid, such a decision shall not affect the validity of the remaining portions of this Ordinance.

Section 7:

The Borough Clerk is hereby directed to give notice at least ten days prior to hearing on the adoption of this Ordinance to the County Planning Board and to all other persons entitled to notice pursuant to N.J.S.A. 40:55D-15 and N.J.S.A. 40:55D-63 (if required). Upon the adoption of this Ordinance after public hearing thereon, the Borough Clerk is further directed to publish notice of the passage thereof and to file a copy of the Ordinance as finally adopted with the Morris County Planning Board as required by N.J.S.A. 40:55D-16. The Clerk shall also forthwith transmit a copy of this Ordinance after final passage to the Borough Tax Assessor as required by N.J.S.A. 40:49-2.1.

Section 8:

This Ordinance shall take effect immediately after final passage and publication and upon approval by the County Review Agency, or sixty (60) days from the receipt of the ordinance by the County Review Agency if the County Review Agency should fail to act.
