ORDINANCE NO. 15-2010

 

AN ORDINANCE AUTHORIZING THE ACQUISITION OF THE FEE SIMPLE INTEREST IN REAL PROPERTY OWNED BY CAROLYN BUTLER DARROW, F/K/A CAROLYN ANN BUTLER, KNOWN AS BLOCK 912, LOT 32 ON THE TAX MAP OF THE BOROUGH MORRIS PLAINS AND ALSO KNOWN AND DESIGNATED AS MOUNTAIN AVENUE, MORRIS PLAINS, NEW JERSEY.

 

WHEREAS, Carolyn Butler Darrow, f/k/a Carolyn Ann Butler, ("Darrow") is the owner of lands located at Lot 32, in Block 912 (the "Property") in the Borough of Morris Plains, Morris County, New Jersey; and

WHEREAS, pursuant to N.J.S.A. 40A:12-4, the Borough Council of the Borough of Morris Plains has determined that it is in the best interests of the Borough to acquire the fee simple interest in said Property at the purchase price of $5,500.00, based on the assessed value of said Property and other factors being considered; and

WHEREAS, Darrow has agreed to convey the fee simple interest in said lands to the Borough of Morris Plains at the stated purchase price of $5,500.00 in accordance with the terms of an Real Estate Purchase Contract between the parties; and

WHEREAS, the Borough Treasurer/Chief Financial Officer of the Borough of Morris Plains has determined that there are sufficient funds available to acquire said interests in the aforesaid Property.

NOW, THEREFORE, BE IT ORDAINED, by the Borough Council of the Borough of Morris Plains, Morris County, New Jersey, they being the governing body thereof, as follows:

Section 1:

The Borough Council hereby authorizes and approves the acquisition for the purchase price of $5,500.00, from Carolyn Butler Darrow, f/k/a Carolyn Ann Butler, of the fee simple interest in certain real property known and designated as Block 912, Lot 32 on the Tax Maps of the Borough of Morris Plains, consisting of

approximately 5,000 square feet of land, more or less, fronting on a paper street known as Mountain Avenue, as depicted on Sheet 9 of the Tax Maps of the Borough of Morris Plains and as set forth in a Deed conveying the said property to Carolyn Ann Butler, dated November 30, 1967 and recorded in the Morris County Clerk’s Office on December 4, 1967, subject to the terms and conditions set forth in the Real Estate Purchase Contract.

Section 2:

The appropriate Borough officials are hereby authorized to take all necessary and proper steps to effectuate and finalize the acquisition, including but not limited to preparation of a metes and bounds description, acquisition of title commitment and preparation of all necessary closing documents.

Section 3:

This Ordinance shall take effect immediately after final passage and publication in accordance with law.
